1. Approve the enclosed Regulations on procedure for distribution of TV programs entering obligatory public packet of TV programs.

2. This resolution becomes effective since July 1, 2015.

Regulations on procedure for distribution of TV programs entering obligatory public packet of TV programs

1. This Provision determines procedure for distribution of TV programs entering obligatory public packet of TV programs (further - public packet).

2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus of July 19, 2005 "About telecommunication" are applied (The national register of legal acts of the Republic of Belarus, 2005, No. 122, 2/1142), the Law of the Republic of Belarus of July 17, 2008 "About mass media" (The national register of legal acts of the Republic of Belarus, 2008, No. 196, 2/1524), the resolution of Council of Ministers of the Republic of Belarus of August 17, 2006 No. 1055 "About approval of Rules of rendering services of telecommunication" (The national register of legal acts of the Republic of Belarus, 2006, No. 160, 5/22959; 2009, No. 136, 5/29839).

3. Radio broadcast of public packet in the territory of the Republic of Belarus is performed by the republican unitary enterprise of telecommunication Beltelekom in digital format if technically possible in open access.

4. Distribution of public packet is performed on terms of the contract about rendering services of telecommunication and (or) the lease agreement of the technical means concluded between the legal entity to who functions of editorial office of mass media (his authorized representative) are assigned (further - edition of TV program), and the operator of telecommunication or the service provider of telecommunication in the approximate forms established by the Ministry of information together with the Ministry of Communications and Informatization.

5. Republican unitary enterprise of telecommunication Beltelekom:

for the purpose of bringing telecommunication by the operator, service provider of telecommunication of public packet to the terminal subscriber device provides in accordance with the established procedure to the operator of telecommunication, the service provider of telecommunication with whom it signs the service provision agreement on delivery of television signal, access to television signal of TV programs entering public packet in telecommunication approved with the operator, the service provider of telecommunication to connection point;

timely informs the operator of telecommunication, the service provider of telecommunication with whom he signs the service provision agreement on delivery of television signal, about changes of technical and organizational conditions of provision of access to television signal of TV program;

notifies the operator of telecommunication, the service provider of telecommunication with whom he signs the service provision agreement on delivery of television signal, on possible failures and malfunctions by provision of access to television signal of TV programs capable to affect quality of finishing telecommunication by the operator, the service provider of telecommunication of TV program entering public packet to the terminal subscriber device.

6. The operator of telecommunication, the service provider of telecommunication shall provide rendering services in provision to subscribers of public packet of proper quality according to requirements of technical regulatory legal acts in the field of technical regulation and standardization in full, without change of form and content of TV programs.

7. Edition of TV program included in public packet signs the service provision agreement of telecommunication and (or) the lease agreement of technical means with the operator of telecommunication, the service provider of telecommunication included in the State register of distributors of products of television and broadcasting mass media.

8. In case of inclusion of TV program in public packet the operator of telecommunication, the service provider of telecommunication shall provide bringing this TV program to subscribers from the date of the conclusion with edition of TV program of the service provision agreement of telecommunication or the lease agreement of the television transferring means.

9. In case of violation of procedure for distribution of public packet operators of telecommunication, service providers of telecommunication bear responsibility according to the legislation.
