1. Approve Regulations on procedure for distribution of TV programs entering obligatory public packet of TV programs it (is applied).

2. This resolution becomes effective since July 1, 2015.

Regulations on procedure for distribution of TV programs entering obligatory public packet of TV programs

1. This Provision determines procedure for distribution of TV programs entering obligatory public packet of TV programs (further - public packet).

2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus of July 19, 2005 No. 45-Z "About telecommunication", the Law of the Republic of Belarus "About mass media", the Rules of rendering services of telecommunication approved by the resolution of Council of Ministers of the Republic of Belarus of August 17, 2006 No. 1055 are applied.

3. Distribution of TV programs entering public packet is performed by distributors of products of television mass media, except for legal entities to which functions of editorial office of television mass media are assigned, in case of distribution of TV programs which are exclusively issued by them (further - distributors of TV programs), by rendering services in broadcast of TV programs with providing to each user of services in broadcast of TV programs of possibility of viewing of TV programs entering public packet on paid and (or) free basis irrespective of method of their distribution.

4. Distributors of TV programs provide rendering services in broadcast of TV programs entering public packet, proper quality according to requirements of technical regulatory legal acts in the field of technical regulation and standardization, technical regulations of the Customs union and the Eurasian Economic Union in full without change of form or content of TV programs.

5. Radio land broadcast of TV programs entering public packet is performed by the republican unitary enterprise of telecommunication Beltelekom (further - RUP "Beltelekom") in digital format if technically possible in open access.

6. Access of RUP "Beltelekom" to television signal of TV programs entering public packet for implementation of radio broadcasting is provided by legal entities to which functions of editorial office of mass media are assigned (further - editions of TV programs), concerning TV programs which are exclusively issued by them on the terms of agreements on radio broadcast of the TV programs entering public packet, concluded between RUP "Beltelekom" and the editorial offices of TV programs.

7. Distribution of television signal with bringing TV programs entering public packet to the terminal subscriber device in other ways which are not relating to radio land broadcasting is performed by distributors of TV programs.

8. Access to distributors of TV programs to television signal of TV programs entering public packet for the purpose of bringing public packet to the terminal subscriber device is provided to RUP "Beltelekom" based on the service provision agreement on delivery of television signal in the connection point approved with distributors of TV programs.

9. By provision of access to television signal of RUP "Beltelekom" timely informs the distributor of TV programs with whom it signs the service provision agreement on delivery of television signal:

about changes of technical and organizational conditions of provision of such access;

about the possible failures and malfunctions capable to affect quality of finishing TV programs entering public packet to the terminal subscriber device the distributor of TV programs.

10. Editions of TV programs entering public packet perform distribution of TV programs which are exclusively issued by them in other ways which are not relating to radio land broadcasting in digital format taking into account the available technical means and (or) transfer them for distribution to distributors of TV programs.

11. In case of violation of procedure for distribution of public packet distributors of TV programs bear responsibility according to the legislation.
