About approval of the Instruction about movement of goods and motor transport through frontier of the Kyrgyz Republic physical persons

For the purpose of streamlining of the procedure of movement of goods and motor transport through frontier of the Kyrgyz Republic by physical persons, and also according to Item 2 of Article 201 of the Customs code of the Kyrgyz Republic, the Government of the Kyrgyz Republic decides:

1. Approve the enclosed Instruction about movement of goods and motor transport through frontier of the Kyrgyz Republic by physical persons.

2. Recognize invalid:

- the order of the Government of the Kyrgyz Republic of June 11, 1997 No. 347 "About approval of Rules of movement by physical persons of goods and other objects through customs border of the Kyrgyz Republic";

- the order of the Government of the Kyrgyz Republic of September 20, 2000 No. 583 "About approval of Rules of movement of vehicles by physical persons through customs border of the Kyrgyz Republic".

3. Publish this resolution in mass media.

4. Determine that this resolution becomes effective in 15 days from the moment of publication.

5. To impose control over the implementation of this resolution on department of finance of the Office of the Prime Minister of the Kyrgyz Republic and the Ministry of Finance of the Kyrgyz Republic.

General provisions

Physical persons can move through frontier of the Kyrgyz Republic any goods, except for the goods forbidden to import to the Kyrgyz Republic and to export from the Kyrgyz Republic specified in appendix No. 1 to this Instruction, with observance of the requirements established by regulatory legal acts of the Kyrgyz Republic.

In this Instruction the following terms are used:

the goods moved with physical persons in the accompanied baggage - the goods (except for motor transport) following through frontier of the Kyrgyz Republic and shown to customs authority by physical person it is direct in case of entrance of this physical person on the territory of the Kyrgyz Republic or its departure from this territory (including in hand luggage);

the goods moved with physical persons in unaccompanied baggage - the goods moved through frontier of the Kyrgyz Republic with carriers according to the transportation agreements (according to the luggage receipt, delivery note, the bill of lading) concluded with physical persons;

motor transport - cars the automobile, cargo and intended for transportation and other vehicles classified in goods items 8701, of 8702, of 8703, 8704 and 8711, trail cars and semitrailer trucks 8716 together with spare parts to them and their regular accessories, the Commodity nomenclature of foreign economic activity of Eurasian Economic Community (further - the Commodity Nomenclature of Foreign Economic Activity of EurAsEC);

new motor transport - motor transport from the moment of which release there passed 3 years and less, irrespective of run size.

Other concepts of this Instruction are used in the values established by the customs legislation of the Kyrgyz Republic.

The customs clearance when moving goods and motor transport through frontier of the Kyrgyz Republic by physical persons is made in the simplified preferential procedure, by declaring by physical person according to the customs declaration of the TD-6 form (further - the customs declaration), and in cases when customs payment, single rate of customs duties and taxes, - according to the customs receipt order (further - TPO) or in the cases determined by this Instruction - according to the customs receipt order of the simplified form is made (further - TPO-UF). For acceleration of the procedure of customs clearance preliminary filling and giving of TPO is allowed. The procedure for filling of TPO, additional sheets to TPO and payments of payments with their application is specified in appendix No. 5 to this Instruction.

The customs clearance of goods when moving through frontier of the Kyrgyz Republic by physical persons is made using the general procedure for tariff and non-tariff measures of regulation, the taxation, except as specified, determined by this Instruction.

When moving motor transport, parts and accessories to motor transport through frontier of the Kyrgyz Republic by physical persons the customs clearance is made according to the Section II of this Instruction.

I. Movement of goods by physical persons through frontier of the Kyrgyz Republic

1. Movement by physical persons of goods for private use

1.1. The goods intended for private use by physical persons, but not for productive, business or other business activity move these persons through frontier of the Kyrgyz Republic (further - border) in the simplified preferential procedure according to provisions of the Customs code of the Kyrgyz Republic and Item 1 of the Section I of this Instruction.

The customs clearance of the goods moved with physical persons, which are not intended for productive, business or other business activity is made without application of non-tariff measures of regulation and the taxation, in cases if they correspond to the criteria determined in subitem 1.2. this Instruction.

1.2. Goods are considered as intended for private use, but not for productive or other business activity if:

1) the frequency of movement of goods does not exceed 1 (one) time a month, except for the goods specified in the paragraph the second Item 1.4. this Instruction;

2) the excise goods imported on customs area of the Kyrgyz Republic do not exceed the below-specified regulations:

- alcoholic beverages (full age persons) - 2 (two) liters;

- tobacco products (full age persons) - 200 (two hundred) pieces of cigarettes;

- carpets - 2 (two) pieces;

3) goods quantity does not exceed the following indicators:

- clothes - 2 (two) subjects of one name, the size and style per capita (except for the personal belongings which were in the use);

- headdresses - 2 (two) subjects of one name, the size and style per capita (except for the personal headdresses which were in the use);

- footwear - 2 (two) subjects of one name, the size and style per capita (except for the personal footwear which was in the use);

- food - 10 (ten) kg per capita;

- toilet accessories and perfumery and cosmetic products - 3 (three) subjects of one name per capita (except for the personal accessories which were in the use);

- furniture - 1 (one) set or set per capita ((*) see the note);

- kitchen household ware and devices - 2 (two) set or service of one type per capita ((*) see the note);

- bedding - 2 (two) sets of one type per capita ((*) see the note);

- photo, audio-, video and office equipment, household appliances and electric devices - 1 (one) subject of each name per capita ((*) see the note);

- jewelry - 6 (six) subjects of different names per capita;

- musical instruments - 1 (one) subject per capita;

- sports equipment - 1 (one) set per capita;

- medicines - 500 grams per capita;

- printing editions, video, audio cassettes, compact disks, film - 10 (ten) pieces of each name per capita ((*) see the note);

- bicycles - 2 (two) pieces per capita;

- children's toys - 2 (two) sets and models per capita ((*) see the note);

- baby carriages - 1 piece per capita;
