1. Approve:

2) regulations of the state service "Licensing for Occupation Activities of the Private Legal Executive", according to appendix 2 to this order.

2. Recognize invalid:

1) the order of the Minister of Justice of the Republic of Kazakhstan of January 28, 2014 No. 26 "About approval of regulations of the state service "Holding Qualification Examination and Licensing, Renewal, Issue of Duplicates of the License for the Occupation Right Activities of the Private Legal Executive" (it is registered in the Register of state registration of regulatory legal acts No. 9109, it is published in information system of law of Ad_let on February 05, 2014);

2) the order of the Minister of Justice of the Republic of Kazakhstan of June 19, 2014 No. 216 "About entering of amendments into the order of the Minister of Justice of the Republic of Kazakhstan of January 28, 2014 No. 26 "About approval of regulations of the state service "Holding Qualification Examination and Licensing, Renewal, Issue of Duplicates of the License for the Occupation Right Activities of the Private Legal Executive" (it is registered in the Register of state registration of regulatory legal acts No. 9547, it is published in information system of law of Ad_let on July 11, 2014).

3. To provide to department on execution of court resolutions of the Ministry of Justice of the Republic of Kazakhstan:

1) state registration of this order and its official publication in periodic printing editions and in information system of law of Ad_let;

2) placement of this order on official Internet resource of the Ministry of Justice of the Republic of Kazakhstan.

4. To impose control of execution of this order on the Responsible secretary of the Ministry of Justice of the Republic of Kazakhstan Beketayev M. B.

5. This order becomes effective after ten calendar days after day of its first official publication.

Regulations of the state service "Carrying Out Certification of the Persons Which Passed Training and Applying for the Occupation Right Activities of the Private Legal Executive"

Chapter 1. General provisions

1. The state service appears territorial authorities of justice of areas, the cities of republican value and the capital (further - the service provider).

Reception of an application and issue of result of rendering the state service is performed through office of the service provider or the web portal of "the electronic government": www.egov.kz, www.elicense.kz (further - the portal).

2. Form of rendering the state service: electronic (partially automated) and (or) paper.

Result of rendering the state service - the decision of the commission on certification of persons applying for the occupation activities of the private legal executive (further - the Commission) about passing or not passing of certification which is drawn up in the form of the minutes of the commission on certification of persons applying for occupation activities of the private legal executive under Department of justice of areas, cities of Astana and Almaty of the Ministry of Justice of the Republic of Kazakhstan according to appendix 1 to the standard of the state service "Carrying Out Certification of the Persons Which Passed Training and Applying for the Occupation Right Activities of the Private Legal Executive" approved by the order of the Minister of Justice of the Republic of Kazakhstan of April 30, 2015 No. 249 (further - the Standard).

In case of the request of uslugopoluchatel for receipt of result of rendering the state service on paper or on the portal, result of rendering the state service it is drawn up in electronic form, certified by the digital signature (further - the EDS) the authorized person of the service provider.

1) KPS and SU of GP RK - Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan;

2) single system of electronic document management of state bodies (further - ESEDO) - the electronic document management system intended for exchange of electronic documents between state bodies of the Republic of Kazakhstan and officials of the relevant state body;

3) the unified register of pre-judicial investigations (further - ERDR) - the automated database in which data on the reasons for the beginning of pre-judicial investigation listed in part one of Article 180 of the Code of penal procedure of the Republic of Kazakhstan proceeding decisions made on them, the made actions, movement of criminal proceedings, applicants and participants of criminal procedure are entered.
