Approve "Rules of accreditation of laboratories of the organizations performing certification of construction materials and products, and also test laboratories" (are attached).

Rules of accreditation of laboratories of the organizations performing certification of construction materials and products, and also test laboratories

1. General provisions

1.1. This Rules are constituted according to article 55.2 of the Town-planning and construction code of the Azerbaijan Republic and determine rules of accreditation of laboratories of the organizations performing certification of construction materials and products, and also test laboratories (further - laboratory).

1.2. The purpose of accreditation of laboratories is increase in confidence to the testing which are carried out to laboratories, protection of the rights and consumer interests established by the legislation, the state and business entities by ensuring the market with quality products.

1.3. Accreditation of laboratories is process of official recognition of compliance of laboratory to the requirements specified in technical regulatory legal acts for the purpose of accomplishment of activities for estimation of compliance, and availability of powers implementation of these activities.

2. Procedure for accreditation of laboratories

2.1. Accreditation of laboratories consists of the below-specified stages:

2.1.1. acceptance of addresses;

2.1.2. estimation;

2.1.3. decision making.

2.2. Acceptance of addresses

2.2.1. Accreditation of laboratory is performed based on submission of the written or electronic application from the applicant (physical persons or legal entities) in Public service of accreditation under the State committee of the Azerbaijan Republic on standardization, metrology and the patent (further - National authority of accreditation).

2.2.2. The laboratory which addressed for accreditation shall meet the requirements of the standards "General Requirements to Powers Test and AZS ISO/IEC 17025:2009 Calibrating Laboratories" (further - standards).

2.2.3. The applicant who is physical person along with the statement shall submit the following documents to National authority of accreditation:

2.2.3.1. regulations on laboratory;

2.2.3.2. passport of laboratory;

2.2.3.3. project of industry of accreditation of laboratory;

2.2.3.4. the regulating document on quality of management system constituted according to standard requirements of laboratory;

2.2.3.5. copy of the identity document.

2.2.4. The applicant who is the legal entity along with the statement shall submit the following documents to National authority of accreditation:

2.2.4.1. regulations on laboratory;

2.2.4.2. passport of laboratory;

2.2.4.3. project of industry of accreditation of laboratory;

2.2.4.4. the regulating document on quality of management system constituted according to standard requirements of laboratory;

2.2.4.5. the copy of the statement from the state register of legal entities.

2.2.5. The written address of the applicant is registered in day of submission to National authority of accreditation, and accreditation process begins.

2.2.6. The national authority of accreditation passes the final decision, having considered the address within 30 days. If the physical person does not submit the documents specified in subitem 2.2. 3, and the legal entity - the documents specified in subitem 2.2.4 of these rules, National authority of accreditation recommends to submit these documents. Non-presentation of documents forms the basis on decision about refusal of issue of the certificate of accreditation.

2.3. Estimation

2.3.1. The national authority of accreditation, based on the submitted documents, on the place estimates compliance of laboratory to requirements of the standard.

2.3.2. Discrepancy of the laboratory which addressed for accreditation to requirements of the standard forms the basis for refusal of accreditation.

2.4. Pronouncement of decisions

2.4.1. If the laboratory conforms to requirements of the standard, the National authority of accreditation passes the decision on accreditation and constitutes the certificate of accreditation. As appendix to the certificate of accreditation, the document on determination of industry of accreditation is constituted. In the document on determination of industry of accreditation the products relating to accreditation industry, types of researches shall be specified.

2.4.2. The national authority of accreditation shall hand to laboratory the certificate of accreditation within 7 (seven) days from the moment of decision making about issue of the certificate of accreditation. If it is not possible to hand the certificate of accreditation and the document on determination of industry of accreditation within 7 (seven) days, these documents immediately go to the applicant by mail.

2.5. The certificate of accreditation is valid within 4 (four) years.

2.6. Expenses on carrying out accreditation are paid by the applicant.

2.7. If illegal actions of National authority of accreditation become origin of expenses for the applicant, expenses are refunded by National authority of accreditation.

2.8. The applicant has the right to appeal actions (decision) of National authority of accreditation in administrative and (or) legal process.
