1. Approve the enclosed standard of the state service "Provision of the Parcel of Land for Asset Construction within the Settlement".

2. To provide to committee on cases of construction, housing and communal services and management of land resources of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Standard of the state service "Provision of the Parcel of Land for Asset Construction within the Settlement"

Chapter 1. General provisions

1. State service "Provision of the Parcel of Land for Asset Construction within the Settlement" (further state service).

2. The standard of the state service (further - the Standard) is developed by the Ministry of Agriculture of the Republic of Kazakhstan (further the Ministry).

3. The state service appears local executive bodies of areas, Nour-Sultan's cities, Almaty and Shymkent, areas and the cities of regional value, akims of the cities of district value, settlements, villages, rural districts (further - the service provider).

Reception of an application and issue of result of rendering the state service are performed through:

1) Government for Citizens State corporation (further State corporation);

2) web portal of "the electronic government": www.egov.kz (further - the portal).

Chapter 2. Procedure for rendering the state service

4. Terms of rendering the state service:

1) from the date of delivery of document package in the State corporation and on the portal:

1 - stage: production of the act of the choice of the parcel of land, with the positive conclusions of the approving bodies and the organizations - 28 (twenty eight) working days;

2 - stage: in case of approval of the final act of the choice and payment for services of land and cadastral works as uslugopoluchatel - decision about provision of the right of land use to the parcel of land - 22 (twenty two) working days;

in case of the appeal to the State corporation, day of acceptance rendering the state service does not enter in time, at the same time the result of rendering the state service by the service provider is provided in the State corporation a day before the termination of term of rendering the state service;

2) the most allowed time of expectation for delivery of document package of 15 (fifteen) minutes;

3) the most allowed time of servicing of 15 (fifteen) minutes.

5. Form of rendering the state service: electronic and (or) paper.

Result of rendering the state service - the decision of the service provider on provision of the right of land use to the parcel of land with appendix of the land cadastral plan or the motivated answer about refusal in rendering the state service in the bases, stipulated in Item 10 these Standards.

On the portal the result of rendering the state service goes to "personal account" of the uslugopoluchatel in electronic form signed by the digital signature (further the EDS) the authorized person of the service provider.

1) the State corporation - Monday through Saturday inclusive, according to the working schedule from 9:00 to 20:00 o'clock, without interruption for lunch, except for Sundays and holidays, according to the labor law of the Republic of Kazakhstan and article 5 of the Law of the Republic of Kazakhstan of December 13, 2001 "About holidays in the Republic of Kazakhstan" (further the Law).

The state service is rendered on the location of the parcel of land according to the procedure of "electronic queue" without the accelerated and preliminary servicing, armoring of electronic queue by means of the portal is possible;

2) the portal - round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan and article 5 of the Law, reception of an application and issue of result of rendering the state service is performed the next working afternoon).
