Approve the Procedure for movement of radioactive waste through frontier abroad and in the Republic of Tajikistan it (is applied).

Procedure for movement of radioactive waste through frontier abroad and in the Republic of Tajikistan

1. This Procedure establishes rules of export and import of radioactive waste on the territory of the Republic of Tajikistan, and also transit of radioactive waste across its territory (further - cross-border movement of radioactive waste).

2. Export, import and transit of radioactive waste is performed according to the decision of the Government of the Republic of Tajikistan.

3. Export of radioactive waste from the territory of the Republic of Tajikistan on the territory of the state which is not the party of the Integrated convention on safety of the treatment of the fulfilled fuel and safety of the treatment of radioactive waste is forbidden. In the presence of the agreement on cross-border movement of radioactive waste signed by the Republic of Tajikistan with the state which is not the party of the Integrated convention on safety of the treatment of the fulfilled fuel and safety of the treatment of radioactive waste, such movement is performed according to requirements of the specified Convention.

4. For receipt of permission to each cross-border movement of radioactive waste the applicant after determination of category of radioactive waste addresses to the state authorized body in the field of ensuring radiation safety the State authorized body in the field of ensuring radiation safety will approve addresses of the applicant with the relevant ministries and departments and represents to the Government of the Republic of Tajikistan for decision making.

5. The list of check points through Frontier of the Republic of Tajikistan through which cross-border movement of radioactive waste is allowed is determined by authorized body concerning customs affairs in coordination with the Agency by chemical, biological, radiation and nuclear safety of National academy of Sciences of Tajikistan, Committee on protection surrounding circles under the Government of the Republic of Tajikistan, the Ministry of transport of the Republic of Tajikistan, Service of the state sanitary and epidemiological surveillance of the Ministry of Health and Social Protection of the Republic of Tajikistan and the State committee of homeland security of the Republic of Tajikistan.

6. The owner of radio of active waste provides information on the moved radioactive waste in the Agency on chemical, biological, radiation and nuclear safety of National academy of Sciences of Tajikistan for modification of the register of radioactive waste.

7. In case of the illicit cross-border movement of radioactive waste on the territory of the Republic of Tajikistan performed as a result of operations of the exporter which is under jurisdiction of the state of export or in case of such movement on the territory of other state allowed by the exporter which is under jurisdiction of the Republic of Tajikistan radioactive waste will be returned to the state from Which territory they were exported.

8. The matters of argument arising when implementing this Procedure are solved according to the current legislation of the Republic of Tajikistan and the international legal acts recognized by the Republic of Tajikistan.

9. The physical persons and legal entities guilty of violation provision of this Procedure, bear administrative and criminal responsibility according to the procedure, established by the legislation of the Republic of Tajikistan.
