About electronic document management by preparation and adoption of legal acts

For the purpose of implementation of electronic document management in process of preparation and adoption of legal acts I decide:

1. Make changes and additions to the following presidential decrees of the Republic of Belarus:

1.1. in Regulations on the National register of legal acts of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of July 20, 1998 No. 369 (The national register of legal acts of the Republic of Belarus, 1999, No. 1, 1/1; 2010, No. 312, 1/12249):

in Item 3 of the word "and electronically" shall be replaced with words "and (or) electronically";

in Item 6:

the fourth to state part in the following edition:

"For inclusion in the National register are represented to NTsPI:

legal acts, except for technical regulatory legal acts and regulatory legal acts, the specified in paragraphs eleven and the twelfth part two of this Item, - in the form of copies of the original on papers or electronic documents;

technical regulatory legal acts - in the form of electronic documents or files with the texts of these acts corresponding to texts of originals on the papers (further - electronic copies of legal acts) certified by the electronic digital signature;

the regulatory legal acts specified in paragraphs eleven and the twelfth to part two of this Item - in the form of copies of the original on papers, either electronic documents, or electronic copies of the legal acts certified by the electronic digital signature, and since January 1, 2017 - in the form of electronic documents or electronic copies of the legal acts certified by the electronic digital signature.";

"Along with legal acts electronic copies of legal acts are presented in the form of copies of the original on papers in NTsPI.

State bodies (organizations) which sent electronic copies of legal acts to NTsPI bear responsibility for their compliance to signed originals.

Requirements to execution of legal acts in the form of electronic documents and electronic copies of legal acts, and also procedure for their submission to NTsPI which are not determined by this Decree are established by NTsPI.";

"1.3. information on technical regulatory legal acts is submitted no later than five working days after signing of the relevant resolutions (orders) in time:

in the State committee on standardization - according to the requirements established by it in the form of copies of originals of these acts on papers and at the same time electronically in the form of files with texts of legal acts (the information about them);

in the National center of legal information - according to the requirements established by it in the form of electronic documents or files with the texts of legal acts corresponding to texts of originals on the papers certified by the electronic digital signature.".

1-1. Determine automation of processes of preparation, approval, conducting examinations, entering into rule-making body and adoptions of drafts of legal acts of the President of the Republic of Belarus, other drafts of legal acts one of the priority directions of further development of rule-making activities.

2. Determine that submission to the National center of the legislation and legal information (further – NTsZPI) legal acts in the form of electronic documents, and also electronic copies of documents on papers:

state bodies which regulatory legal acts are subject to the obligatory legal expertize which is carried out by the Ministry of Justice or head departments of justice of regional executive committees it is performed by means of the automated information system providing forming of the National register of legal acts of the Republic of Belarus;

other state bodies (officials) except for specified in the paragraph the second this Item it is performed by means of system of interdepartmental electronic document management of state bodies or other systems and means used for transfer of electronic documents determined by Council of Ministers of the Republic of Belarus.

In exceptional cases in case of impossibility of use of the systems intended for transfer of electronic documents for the reasons, independent of state bodies, the legal acts specified in part one of this Item are presented in NTsZPI in the form of copies of the original on papers with simultaneous submission of files with the texts of these legal acts corresponding to texts of originals on papers.

The legal acts containing office information of limited distribution, to system implementation, the security requirements of the specified information established by the legislation intended for transfer of electronic documents and providing observance, are presented in NTsZPI in the form of copies of the original on papers with simultaneous submission of files with the texts of these legal acts corresponding to texts of originals on papers.

3. To regional executive committees together with NTsPI till January 1, 2016 to implement the automated information system called in the paragraph the second Item 2 of this Decree in head departments of justice of regional executive committees and local councils of deputies, executive and administrative organs of basic territorial level.

4. To provide to the Ministry of Finance together with Administration of the President of the Republic of Belarus selection not later III quarter 2015 of NTsPI of funds from the republican budget for acquisition of the departmental electronic document management system providing interaction with system of interdepartmental document flow of state bodies and use of means of the electronic digital signature.

5. Provide together with NTsPI forming on paid contractual basis of the databanks containing the accepted (published) state bodies (officials), other state organizations local legal acts and documents connected with use and practical application of the legal acts adopted by them as a part of the STANDARD information retrieval system:

to state bodies and other state organizations, subordinate (accountable) to the President of the Republic of Belarus, and also the State Control Committee, the Prosecutor General's Office, the Office of Council of Ministers of the Republic of Belarus, republican state bodies, other state organizations subordinated to the Government of the Republic of Belarus, regional and Minsk city to executive committees till January 1, 2017;
