1. Approve the enclosed Regulations on the state energy supervision and control of the Republic of Kazakhstan.

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of the copy of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Regulations on the state energy supervision and control of the Republic of Kazakhstan

1. This Regulations on the state energy supervision and control of the Republic of Kazakhstan (further - the Provision) are developed according to the subitem 2) of article 5 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" and establish procedure for the organization and implementation of supervision and control in the field of power industry.

2. The state energy supervision is exercised behind reliability, safety and profitability of production, transfer, technical scheduling and consumption of electrical energy.

3. Task of the state energy supervision and control is the prevention, identification and suppression of violations of technical requirements of regulatory legal acts by physical persons and legal entities in the field of power industry in case of operation of the energy equipment of power plants, power networks, electrical units of consumers.

4. The state energy control is exercised for:

1) observance of requirements of specifications for quality of electrical and heat energy;

2) observance of instructions for use electrical and heat energy within the competence;

3) rational and economical use, optimization of the modes of production, transfer, consumption of electrical and heat energy;

4) readiness of power plants, power and thermal networks for work in autumn and winter conditions;

5) fulfillment of technical requirements of regulatory legal acts of the Republic of Kazakhstan in the field of power industry;

6) exploitation and technical condition of the energy equipment of power plants, power and thermal networks, and also the electric and heatusing installations of consumers.

5. The state energy control in the field of power industry is exercised in the form of checks and other forms.

6. Checks when implementing the state energy supervision and control will be organized and carried out according to requirements of the Law of the Republic of Kazakhstan of January 6, 2011 "About the state control and supervision in the Republic of Kazakhstan", except for checks behind observance of requirements for operation and technical condition of the energy equipment of power plants of single electric utility system of the Republic of Kazakhstan, power networks over 0,4 of kilovolts, the high-level thermal networks and boiler rooms with installed capacity more than 100 Gigakallory / hour.

7. Body for the state energy control according to the procedure, established by the legislation of the Republic of Kazakhstan:

Access to electro-and power stations has 1);

2) is performed by periodic inspection of technical condition of the energy equipment of power plants, power and thermal networks, and also the energy equipment of consumers;

3) performs certification of heads and specialists of the energy organizations;

4) performs accreditation of the organizations on conducting energy examination and electrolaboratories, control over the implementation of energy saving policy, inspection of energy efficiency of legal entities;

5) performs preparation of suggestions for improvement of the legislation of the Republic of Kazakhstan in the field of power industry;

6) involves experts when carrying out inspection of the under control energy equipment, complex checks of the energy organizations and in case of investigation of technology violations in operation of the energy equipment of power plants, power and thermal networks;

7) organizes development of normative and methodical acts, legal and economic mechanisms of energy saving;

8) makes offers to owners of the organizations about attraction to disciplinary responsibility of persons guilty of assumption of accidents, accidents and other gross violations of technical requirements of regulatory legal acts in the field of power industry, or to direct materials to the relevant state bodies about attraction to administrative or criminal liability according to the laws of the Republic of Kazakhstan of persons guilty of violation of the law of the Republic of Kazakhstan about power industry;

9) participates in work of the commissions of the electrical power companies for assessment of readiness of objects and the equipment to work in winter conditions;

Records 10) investigations of large technology violations in work of power plants, the thermal and power networks which led to separation of single electric utility system of the Republic of Kazakhstan into several parts, mass restriction of consumers on electrical and heat energy, damage of the large energy equipment.
