About approval of Rules of issue of quotas for emissions of greenhouse gases

1. Approve the enclosed Rules of issue of quotas for emissions of greenhouse gases.

2. Declare invalid the order of the Minister of environmental protection of the Republic of Kazakhstan of May 15, 2013 No. of the 124th "About approval of the application form on receipt of the certificate on emissions of greenhouse gases" (registered in the Register of state registration of regulatory legal acts for No. 8509, No. 299 published in the Kazakhstanskaya Pravda newspaper of October 23, 2013 (27573).

3. To provide to department on climate change of the Department of Energy of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

5. This order becomes effective after twenty one calendar days after its first official publication.

Rules of issue of quotas for emissions of greenhouse gases

1. General provisions

1. These rules of issue of quotas for emissions of greenhouse gases (further - Rules) are developed according to the subitem 30) of article 17 of the Ecological code of the Republic of Kazakhstan of January 9, 2007 (further - the Code) and determine procedure for issue of quotas for emissions of greenhouse gases.

2. In these rules the following terms and determinations are used:

1) the account of operator of the quota installation - type of the account in the state register of carbon units of the Republic of Kazakhstan opened for the users of nature falling under requirements for quoting of emissions of greenhouse gases;

2) the operator of installation - the legal entity, or in legal use of which in the territory of the Republic of Kazakhstan is in property installation which functioning provides emissions of greenhouse gases;

3) the passport of installation - the document containing data on geographical location of the installation performing emissions of greenhouse gases, types of activity and characteristics of the used technology, scope baseline of emissions and technique of their calculation, and also the plan of monitoring and other data necessary for accounting of installations;

4) quota for emissions of greenhouse gases - the quantitative amount of regulated emissions of greenhouse gases distributed on the user of nature for action of the national plan of distribution of quotas for emissions of greenhouse gases (further - the national plan);

5) the installation falling under requirements for quoting of emissions of greenhouse gases - installation on which the quota for emissions of greenhouse gases according to requirements of Item 1 of article 94-2 of the Code is established;

6) the certificate - the document establishing the amount of the permitted emissions of greenhouse gases issued to the user of nature for the purpose of accomplishment of its emission reduction commitments of greenhouse gases and participation in trade in carbon units;

7) the independent accredited organization - the organization accredited by authorized body in the field of environmental protection (further - authorized body) on implementation of verification, validation and activities for confirmation of inventory reports of greenhouse gases.

3. Issue of quotas for emissions of greenhouse gases in the Republic of Kazakhstan to the users of nature falling under quoting of emissions of greenhouse gases is performed by means of transfer of the corresponding quantity of units of quotas for the account of operator of the quota installation in the state register of carbon units of the Republic of Kazakhstan, after receipt of the certificate by it on emissions of greenhouse gases.

4. The total amount of quotas for emissions of greenhouse gases intended for obtaining by the user of nature on installation is determined for the entire period of its operation within effective period of the national plan and fixed in the certificate, the issued authorized body.

2. Procedure for issue of quotas for emissions of greenhouse gases

5. Users of nature for the purpose of receipt of quotas for emissions of greenhouse gases and participation in trade in carbon units submit the following documents confirmed with the independent accredited organization to authorized body:

1) the inventory report of greenhouse gases for accounting year;

2) passport of installation;

3) program of emission reduction of greenhouse gases;

4) the actions plan on projects implementation on emission reduction of greenhouse gases.

6. The application on emissions of greenhouse gases is submitted for receipt of the certificate by the user of nature in form according to appendix 1 to these rules.

7. The inventory report of greenhouse gases is developed according to the Report form about the inventory count of greenhouse gases approved by the order of the Minister of environmental protection of the Republic of Kazakhstan of May 15, 2013 No. of 123rd (it is registered in the Register of state registration of regulatory legal acts for No. 8497).
