Rules of use of reserves of the Government of the Republic of Kazakhstan and local executive bodies

1. General provisions

1. These rules of use of reserves of the Government of the Republic of Kazakhstan and local executive bodies (further - Rules) determine procedure for use of reserves of the Government of the Republic of Kazakhstan and local executive bodies.

2. In these rules the following concepts are used:

1) the Commission concerning the international humanitarian assistance (further - the commission) - the advisory advisory body under the Government of the Republic of Kazakhstan concerning the international humanitarian assistance formed for development of offers on the questions carried to competence of the Government of the Republic of Kazakhstan;

2) unforeseen costs - the costs which are not planned in case of development republican and the local budgets the current financial year owing to their unexpectedness and requiring immediate financing in the current financial year, including on risks of untimely repayment and servicing guaranteed by the state of loans attracting reputation and financial consequences for the Republic of Kazakhstan or with risks of rise in price and (or) suspension of construction of engineering infrastructure;

3) the official humanitarian assistance of the Republic of Kazakhstan - the help gratuitously rendered by the Republic of Kazakhstan to other states for the purpose of liquidation of emergency situations of social, military, ecological, natural and technogenic nature in the territory of other states.

2. Procedure for use of reserves of the Government of the Republic of Kazakhstan and local executive bodies

2) when the need for money of reserve of the Government of the Republic of Kazakhstan and local executive bodies arose in the current financial year and need for them is not connected with last obligations of the administrator of the budget program, except as specified repayments of obligations of the Government of the Republic of Kazakhstan, the central state bodies, local executive bodies on:

to decisions of the courts;

to subsidizing of losses (debts) of the power making organizations which are in municipal property, hundred percent of shares (share in the authorized capital) which belong to the state, and performing at the same time activities for production of electrical energy, water (distillate) and heat energy;

3) availability of the positive recommendation of the commission of use of extraordinary reserve on rendering the official humanitarian assistance by the Republic of Kazakhstan;

4) availability of the order of the Prime Minister of the Republic of Kazakhstan for the purpose of use of reserves of the Government of the Republic of Kazakhstan for life support of the population in case of liquidation of emergency situations of natural and technogenic nature;

5) availability of the positive recommendation of the Republican headquarters about coordination of antiflood actions and mitigation of consequences of the flood period of 2024 or the order of the Prime Minister of the Republic of Kazakhstan for the purpose of use of reserves of the Government of the Republic of Kazakhstan or local executive body for compensation of the property harm done to the population, compensation of property losses to subjects of small and medium business, including subjects of agro-industrial complex on real estate as a result of consequences of floods of 2024.
