ORDER OF THE MINISTER OF ENERGY OF THE REPUBLIC OF KAZAKHSTAN

About approval of standard rates and requirements to the materials and substances necessary for work on cleaning of the sea

(as amended of the Order of the Minister of Energy of the Republic of Kazakhstan of 15.11.2016 No. 492)

According to subitem 23-6) of article 18 of the Law of the Republic of Kazakhstan of June 24, 2010 "About subsoil and subsurface use" I ORDER:

1. Approve the enclosed standard rates and requirements to the materials and substances necessary for work on cleaning of the sea.

2. Declare invalid the order of the Minister of environmental protection of the Republic of Kazakhstan of July 9, 2013 No. 202-O "About approval of the list of dispersants for application in the Kazakhstan sector of the Caspian Sea" (it is registered in the Register of state registration of regulatory legal acts for No. 8605, No. 305(27579)) is published in the Kazakhstanskaya Pravda newspaper of 31.10.2013.

3. To provide to committee of ecological regulation, control and state inspection in oil and gas complex of the Department of Energy of the Republic of Kazakhstan in the procedure for the Republic of Kazakhstan established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

4. To impose control of execution of this order on the supervising Vice-Minister of Energy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after its first official publication.

Standard rates and requirements to the materials and substances necessary for work on cleaning of the sea

1. General provisions

1. These Standard rates and requirements to the materials and substances necessary for work on cleaning of the sea (further - Standard rates) are developed according to subitem 23-6) of article 18 of the Law of the Republic of Kazakhstan of June 24, 2010 "About subsoil and subsurface use" (further - the Law).

2. Sea constructions, trunk oil pipelines, seaports are equipped with required materials and substances for liquidation of oil spill of the first and second levels according to Item 5 of Article 95 and Item 4, of the 10th article 95-1 of the Law, the List of dispersants for liquidation of emergency oil spills in the sea and internal reservoirs of the Republic of Kazakhstan approved by the order of the Minister of Energy of the Republic of Kazakhstan of June 21, 2016 No. 262 (registered in the Register of state registration of regulatory legal acts for No. 14018).

3. Levels of oil spills at the sea are established according to article 95-1 of the Law.

2. Standard rates to the materials and substances necessary for work on cleaning of the sea

4. Standard rates which are connected with work on cleaning of the sea, including with effective actions for liquidation of oil spills:

1) availability sufficient (by the sizes of perimeter of sea construction) the number of bonds for localization of diffuse oil;

2) availability of the petrodetaining materials made of the absorbing substances, (floating mats), towed by courts, for localization and catching of oil from water surface in case of the first and second levels of the oil spills which are on the coastal bases as close as possible to places of conducting works;

3) availability of radar reflector or other materials for ensuring detection of sea construction by courts in different weather conditions;

4) availability of the additional materials and substances necessary for collection of oil from surface of the water used from vessel board in case of floods of the second level;

5) availability within thirty-minute reach of the materials, substances and the equipment sufficient for liquidation of floods of the first level.

5. Depending on the chosen methods of liquidation of oil spills at the sea, based on risks assessment the necessary additional resources required for work on cleaning of the sea and coastal zone are determined: absorbents, lift trucks, sprayers of dispersants, vessels tows, pumps, tanks, barges, warehouses, barrels, trolleys, vacuum aggregates, plastic sheets, aircraft, vehicles.

3. Requirements to the materials and substances necessary for work on cleaning of the sea

6. Requirements are based on settlement environment of work in the Kazakhstan sector of the Caspian Sea when carrying out oil operations which consider:

1) potential long-term fluctuations of sea level;

2) the short-term storm setups and sgona influencing sea level;

3) winter ice cover from November to April under normal (average) weather conditions in the shallow-water circle (0-10 m);

4) potentially dangerous movement of ice and heap around sea constructions;

5) extreme changes of temperatures during the period between summer and in the winter;
