About approval of Rules of maintaining the State register of objects of national cultural property

According to subitem 21-1) of article 7 of the Law of the Republic of Kazakhstan "About culture", I ORDER:

1. Approve the enclosed Rules of maintaining the State register of objects of national cultural property.

2 For culture and art of the Ministry of Culture and sport of the Republic of Kazakhstan in the procedure established by the legislation to provide to department:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Culture and sport of the Republic of Kazakhstan after its official publication;

4) submission to Department of legal service of the Ministry of Culture and sport of the Republic of Kazakhstan of data on execution of the actions provided by this Item within ten working days from the date of execution of actions.

3. To impose control of execution of this order on the Vice-Minister for Culture and Sports of the Republic of Kazakhstan G. Akhmedyarov.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining the State register of objects of national cultural property

Chapter 1. General provisions

1. These rules of maintaining the State register of objects of national cultural property (further - Rules) determine procedure for maintaining the State register of objects of national cultural property (further - the State register).

2. The state register is kept for the purpose of preserving objects of national cultural property (further - ONKD) and giving of particular treatment to them.

3. Data on ONKD having special value for history and culture of the country are entered in the State register.

Chapter 2. Procedure and conditions of maintaining the State register

4. The state register is kept by authorized body in the field of culture (further – authorized body) in the Kazakh and Russian languages, on paper and electronic carriers in form according to appendix, to these rules.

5. Data on the basis are entered in the State register:

1) letters of local executive body of area, the city of republican value and the capital (further - MIO) with indication of data on ONKD;

2) petitions of physical person with indication of data on ONKD;

3) petitions of the legal entity with indication of data on ONKD.

6. In the letters and petitions specified in Item 5 of these rules the following data are specified:

1) full name of ONKD;

2) description of ONKD;

3) date of creation of ONKD;

4) data ONKD;

5) ONKD origin;

6) location of ONKD;

7) photo of ONKD.

7. If in the documents specified in Item 5 of these rules data not corresponding to Item 6 of these rules are specified, or describe ONKD for determination of its special value not enough, the authorized body sends inquiry to MIO, to physical persons or legal entities for need to provide the missing information on ONKD.

8. The authorized body within thirty working days considers the documents specified in Item 5 of these rules.

9. For consideration of the documents specified in Item 5 of these rules, the authorized body creates permanent commission of experts.

Staff of the relevant division of authorized body, scientists and qualified specialists in the fields of history, culture, archeology, paleontology, ethnography, fine and folk applied art are part of commission of experts. The chairman of commission of experts is the representative of authorized body.

The decision of commission of experts is made by open voting by a majority vote from total number of the members of commission of experts who are present at its meeting. In case of equality of votes the voice of the chairman of commission of experts is decisive.

The commission of experts makes the decision on availability or on absence at ONKD of special value for history and culture of the country and draws up it the protocol.

10. Based on the protocol of commission of experts the authorized body during the term specified in Item 8 of these rules accepts one of the following decisions:

To enter 1) in the State register data on ONKD;

2) ONKD is not subject to entering into the State register as has no special value for history and culture of the country.

10-1. The authorized body informs MIO, physical persons and legal entities within ten working days from the date of decision making on the made decision.

11. ONKD exception of the State register is performed based on letters of MIO or petitions of physical persons or legal entities for complete physical loss of ONKD or loss of special value for history and culture of the country.

12. At the request of state bodies of the Republic of Kazakhstan, appeals of physical persons and legal entities, the authorized body represents data on the ONKD included or excluded from the State register, according to the procedure and the terms established by the Administrative procedural Procedure Code of the Republic of Kazakhstan.
