About guarantees of social protection of separate categories of citizens

Article 1. Subject of regulation of this Federal Law

This Federal Law provides establishment of guarantees of social protection of separate categories of citizens of the Russian Federation in connection with acceptance in the Russian Federation of the Republic of Crimea and education as a part of the Russian Federation of new subjects - the Republic of Crimea and the federal city of Sevastopol.

Article 2. Application of this Federal Law

This Federal Law extends to the following categories of citizens of the Russian Federation:

1) the judges in resignation who were constantly living for March 18, 2014 in the territories of the Republic of Crimea and the federal city of Sevastopol and being for March 18, 2014 receivers of the monthly perpetual monetary pay appointed according to the legislation existing in the territories of the Republic of Crimea and the federal city of Sevastopol till February 21, 2014;

2) the judges in resignation who were constantly living for March 18, 2014 in the territories of the Republic of Crimea and the federal city of Sevastopol and having the right for March 18, 2014 to purpose of monthly perpetual monetary pay according to the legislation existing in the territories of the Republic of Crimea and the federal city of Sevastopol till February 21, 2014;

3) the judges of the courts operating in the territories of the Republic of Crimea and the federal city of Sevastopol which were constantly living for March 18, 2014 in the territories of the Republic of Crimea and the federal city of Sevastopol and are not appointed to positions of judges when forming according to the Federal Law of June 23, 2014 No. 156-FZ "About procedure for candidate screen in initial structures of federal courts replacing positions for March 18, 2014, created in the territories of the Republic of Crimea and the federal city of Sevastopol" initial structures of courts of the Russian Federation;

4) the judges of the courts operating in the territories of the Republic of Crimea and the federal city of Sevastopol which were constantly living for March 18, 2014 in the territories of the Republic of Crimea and the federal city of Sevastopol and appointed to positions of judges when forming according to the Federal Law of June 23, 2014 No. 156-FZ "About procedure for candidate screen in initial structures of federal courts replacing positions for March 18, 2014, created in the territories of the Republic of Crimea and the federal city of Sevastopol" initial structures of courts of the Russian Federation.

Article 3. Procedure for calculation of length of service for establishment of monthly surcharge for long service, calculations of length of service in case of purpose of the monthly perpetual maintenance and dismissal wage

1. To the citizens of the Russian Federation specified in Item 2 of article 2 of this Federal Law length of service for purpose of monthly perpetual monetary pay joins the work periods:

1) on positions of judges of courts of USSR, Ukraine;

2) on other positions which were included in length of service of judges according to the legislation existing in the territories of the Republic of Crimea and the federal city of Sevastopol till February 21, 2014.

2. To the citizens of the Russian Federation specified in Items 3 and 4 of article 2 of this Federal Law the length of service of judges for establishment of monthly surcharge for long service joins the work periods:

1) on positions of judges of courts of USSR, Ukraine;

2) on positions of judges of the courts operating in the territories of the Republic of Crimea and the federal city of Sevastopol till December 26, 2014;

3) on other positions which were included in length of service of judges according to the legislation existing in the territories of the Republic of Crimea and the federal city of Sevastopol till February 21, 2014.

3. To the citizens of the Russian Federation specified in Items 3 and 4 of article 2 of this Federal Law in length of service for purpose of the monthly perpetual maintenance and dismissal wage operating time on judgeship in courts of various level and jurisdiction in USSR, in Ukraine, in the courts operating in the territories of the Republic of Crimea and the federal city of Sevastopol till December 26, 2014 and also time of prior work on the positions specified in article 7 of the Federal Law of January 10, 1996 to No. 6-FZ "About additional guarantees of social protection of judges and workers of offices of courts of the Russian Federation" is set off.

Article 4. Procedure for appointment, payment of the monthly perpetual maintenance and dismissal wage

1. Persons specified in Items 2 and 3 of article 2 of this Federal Law at their choice have the right to award of pension in accordance with general practice or to the monthly perpetual maintenance according to regulations of Item 5 of article 15 of the Law of the Russian Federation of June 26, 1992 No. 3132-1 "About the status of judges in the Russian Federation".

2. The monthly perpetual maintenance in the amount of, established according to the legislation existing in the territories of the Republic of Crimea and the federal city of Sevastopol till February 21, 2014 is paid to persons specified in Item 1 of article 2 of this Federal Law. At the same time the general size of the monthly perpetual maintenance cannot be lower than the size of monthly perpetual monetary pay, and also other guarantees established in cash and paid to these persons as of day of entry into force of this Federal Law.

3. To persons specified in Item 3 of article 2 of this Federal Law:

1) the dismissal wage is paid according to regulations of Item 3 of article 15 of the Law of the Russian Federation of June 26, 1992 to No. 3132-1 "About the status of judges in the Russian Federation";

2) the monthly perpetual maintenance and dismissal wage are estimated from the size of the monthly monetary reward which could be added to the judge working at the corresponding position. At the same time positions of persons specified in Item 3 of article 2 of this Federal Law are considered corresponding to positions of judges of courts of the Russian Federation according to appendix to this Federal Law.

4. To persons specified in Items 1 and 2 of article 2 of this Federal Law, the sizes of the monthly perpetual maintenance increase also terms which are provided for increase (indexation) in the sizes of official pay rates of judges in the Russian Federation (are indexed) in sizes.
