1. Approve the enclosed Rules of approval and approval of feasibility statements and construction projects of objects for use of renewable energy resources for the purposes of heat supply.

2. To provide to department on renewable energy resources of the Department of Energy of the Republic of Kazakhstan in the procedure for the Republic of Kazakhstan established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of approval and approval of feasibility statements and construction projects of objects for use of renewable energy resources for the purposes of heat supply

1. These rules of approval and approval of feasibility statements and construction projects of objects for use of renewable energy resources for the purposes of heat supply (further - Rules) are developed according to subitem 10-4) of article 6 of the Law of the Republic of Kazakhstan of July 4, 2009 "About support of use of renewable energy resources" and determine procedure for approval and approval of feasibility statements and construction projects of objects for use of renewable energy resources for the purposes of heat supply.

2. In these rules the following concepts are used:

1) object for use of renewable energy resources - the technical devices intended for production of electrical and (or) heat energy with use of renewable energy resources, and constructions and the infrastructure technology necessary for operation of object for use of renewable energy resources interconnected with them and which are on balance of the owner of object for use of renewable energy resources;

2) thermal network - set of the devices intended for transfer, distribution of heat energy;

3) the customer (investor) - the physical person or legal entity having intention to perform asset construction on use of renewable energy resources for the purposes of heat supply.

3. Action of these rules does not extend to the construction projects of objects for use of renewable energy resources for the purposes of heat supply financed from republican or local budgets.

4. The customer (investor) after development of the feasibility statement on construction of facilities on use of renewable energy resources for the purposes of heat supply (further - the feasibility statement) and the construction project of objects for use of renewable energy resources for the purposes of heat supply (further - the construction project) directs them to receipt of the conclusion of complex non-departmental examination according to Rules of conducting complex non-departmental examination of the feasibility statements and the design estimates intended for construction new, and also changes (reconstruction, expansions, modernization, upgrade and capital repairs) the existing buildings and constructions, their complexes, engineering and transport communications irrespective of financing sources, approved by the order of the Minister of national economy of the Republic of Kazakhstan of April 1, 2015 No. 299 (registered in the Register of state registration of regulatory legal acts No. 10722).

5. The feasibility statement affirms the Customer (investor) no later than three months after receipt of the positive conclusion of complex non-departmental examination.

6. The customer (investor) for review the construction project with local executive body of areas, the cities of republican value and the capital (further - local executive body) in the territory of which the asset construction on use of renewable energy resources for the purposes of heat supply is planned, sends to local executive body the construction project with appendix of the following documents:

1) the copy of the feasibility statement approved by the customer (investor);

2) the copy of the decision of local executive body on provision of the parcel of land under asset construction on use of renewable energy resources for the purposes of heat supply;

3) the copy of the document (letter) confirming possibility of connection of object for use of renewable energy resources for the purposes of heat supply to thermal networks of the power transferring organization;

4) the positive conclusion of complex non-departmental examination to the construction project.

7. The local executive body considers and approves the construction project within fifteen calendar days from the date of its obtaining.

8. The construction project affirms the Customer (investor) no later than three months after day of its approval of local executive body.
