About the prevention and fight against human trafficking

This Law determines organization-legal bases by the prevention and fight against human trafficking, the procedure for coordination of activities of the bodies performing fight against human trafficking installs system of measures for protection and assistance to the victims of human trafficking.

Chapter I. General provisions

Article 1. The concepts used in this Law

The concepts used for the purposes of this Law are applied in the following value:

recruitment - employment, set of faces for accomplishment of any works, attraction them to any activities, including illegal, involvement in structure of any organization, including activities of which is forbidden by the law;

the national mechanism of redirection of the victims of human trafficking is set of actions of state bodies, non-profit organizations, and also the specialized agencies directed to assistance and protection of the victims of human trafficking;

forced or obligatory labor (forced labor) - any work (rendering services) or the service required from the face under the threat of any punishment for which accomplishment this person did not offer the services voluntarily, except the cases determined by the Constitution of the Kyrgyz Republic and the labor law;

slavery - condition or provision of person concerning which some or all competences inherent in the property right are performed;

human trafficking - recruitment, transportation, concealment, obtaining, acceptance or the transfer of the person performed from its consent or without consent by threat, use of force or other forms of coercion, blackmail, stealing, fraud, deception, authority misuse or vulnerability of provision or way of bribery or the offer of benefits for receipt of consent of person controlling it for the purpose of operation;

the dealer in people - physical person or legal entity which independently or in group of persons makes any actions connected with human trafficking and also the official who the actions promotes human trafficking and equally does not interfere and does not resist to it though shall do it owing to the ex-officio full powers;

shelter - the special facility performing activities for counteraction to human trafficking, created in the procedure established by this Law and intended for temporary residence of the victims of human trafficking;

the center - the special facility performing activities for counteraction to human trafficking, created in the procedure established by this Law and intended for the consulting, legal, public assistance to the victims of human trafficking;

operation - involvement of person in criminal activities; compulsion of person to the prostitution or other forms of sexual activities, forced labor or services, slavery or customs similar to slavery, adoption (adoption) for commercial purposes, use in armed conflicts;
