1. Approve Provisional regulations for licensing of production and turnover of ethyl alcohol, production and turnover (storage for the purpose of production or realization, wholesale and retail sale) alcoholic products according to appendix.

2. Bring in the order of the Government of the Kyrgyz Republic "About licensing of separate types of activity" of May 31, 2001 No. 260 the following change:

In Regulations on licensing of separate types of activity:

- recognize Chapter 28 invalid.

3. This resolution becomes effective after fifteen days from the date of official publication and is effective before entry into force of the Regulations on licensing of separate types of activity approved by the Government of the Kyrgyz Republic.

Provisional regulations for licensing of production and turnover of ethyl alcohol, production and turnover (storage for the purpose of production or realization, wholesale and retail sale) alcoholic products

Chapter 1. General provisions

1. The license is understood as the document issued by the licensor to the licensee certifying the right to implementation of activities for production and turnover of ethyl alcohol, to production and turnover (storage for the purpose of production or realization, wholesale and retail sale) alcoholic products, according to the requirements established by the Law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic" and these Provisional regulations.

2. Licensor is the State agency on control of production and turnover of ethyl alcohol, alcoholic products under the Cabinet of Ministers of the Kyrgyz Republic.

3. Physical persons and legal entities, irrespective of legal forms and patterns of ownership, shown willingness to be engaged in the licensed type of activity or to make the certain actions which are subject to licensing shall obtain the license according to the procedure, established by these Provisional regulations.

The right of implementation of the licensed activities at legal entity or physical person comes from the moment of receipt of the license.

4. If other is not stipulated by the legislation the Kyrgyz Republic and these Provisional regulations, foreign legal entities and physical persons, and also persons without citizenship obtain the license on the same conditions and in the same procedure as legal entities and physical persons of the Kyrgyz Republic.

5. The procedure of licensing is performed on the principles, the stipulated in Article 5 Laws of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic".

6. Licenses for production and turnover of ethyl alcohol, both production and turnover (storage for the purpose of production or realization, wholesale and retail sale) alcoholic products are inaliennable.

Chapter 2. Content and forms of the license

7. In the license the following details shall be specified:

- full name of the licensing body;

- full name of the legal entity or full name of the physical person - the licensee;

- location (residence) of the legal entity (citizen);

- type (types) of the licensed activities;

- the address of implementation of the licensed type of activity;

- date of issue of the license;

- license effective period (if it is established);

- number and series of the form of the license;

- registration license number according to the register of licenses;

- identification taxpayer number;

- inalienability of the license.

8. Forms of licenses shall be made by typographical method, have security degree, accounting series and number. Forms of licenses are documents of strict accounting. Production, accounting and storage of forms of licenses is performed by the licensing body.

9. Upon the demand of interested persons the licensee shall show the original of the license or the copy of the license certified of the procedure established by the legislation.

If the licensee submitted the application for issue of the duplicate, renewal of the license, presentation of the copy of the license is allowed.

10. In case of loss or spoil of authentic copy of the license the licensee submits the application to the licensing body for issue of the duplicate. The licensee shall submit the application within five working days from the date of loss or spoil of authentic copy of the license. All details of the lost form of the license shall be specified in the statement.

11. The duplicate is issued based on the documents which are available for the licensor. In case of issue of the duplicate the registration license number according to the Register of licenses remains invariable. The granted license shall have the mark "Duplicate".

In case of detection by the licensee of the lost authentic copy of the license, it shall give authentic copy (or the duplicate) to the licensor for cancellation.

12. Checks, inspections, surveys, expertizes of the licensee for issue of the duplicate are not carried out.

13. Issue of the duplicate is performed within three working days from the date of submission of the corresponding statement by the licensee.

14. Before issue of the duplicate of the license the licensee performs activities based on the copy of earlier granted license.

Chapter 3. Licensed requirements and conditions

15. Mandatory licensed requirements are:

1) on production and turnover of ethyl alcohol:

- availability of the factory buildings belonging to the applicant on the property right, constructions, storage and stationary facilities, and also the equipment necessary for production and the turnover of ethyl alcohol conforming to requirements of sanitary and epidemiologic, ecological and fire safety;
