About approval of Strategy about biological diversity of the Republic of Moldova for 2015-2020 and the Action plan on its implementation

(as amended of the Order of the Government of the Republic of Moldova of 21.11.2018 No. 1143)

For the purpose of ensuring implementation of provisions of the Program of activities of the Government of the Republic of Moldova for 2015-2018, and also in the field of environmental protection and rational use of natural resources the Government DECIDES: creations of strategic base

1. Approve:

Strategy about biological diversity of the Republic of Moldova for 2015-2020 according to appendix No. 1;

The action plan on implementation of Strategy about biological diversity of the Republic of Moldova for 2015-2020 according to appendix No. 2.

2. To the ministries and other central administrative authorities:

provide accomplishment of necessary measures for strategy implementation about biological diversity of the Republic of Moldova for 2015-2020 and the Action plan on its implementation according to competences;

represent to the Ministry of Agriculture, regional development and the environment annually till February 1 reports on the course of accomplishment of adequate measures.

3. To the Ministry of Agriculture, regional development and environment:

perform cooperation with the international organizations and potential donors for the purpose of attraction of the necessary volume of investment for implementation of regulations of Strategy on biological diversity of the Republic of Moldova for 2015-2020 and the Action plan on its implementation;

provide to the Government annually till March 1 information on accomplishment of the specified Action plan.

4. Recommend to bodies of local public authority to take necessary measures for accomplishment of the provisions specified Strategy and the Action plan.

5. To impose control of execution of this resolution on the Ministry of Agriculture, regional development and the environment.

Strategy about biological diversity of the Republic of Moldova for 2015-2020

I. Introduction

Strategy about biological diversity of the Republic of Moldova for 2014-2020 (further – Strategy) reflects present condition of biological diversity in the Republic of Moldova, tendencies to change of components of biodiversity, the purpose and tasks of the actions directed to protection of biodiversity.

The concept of biodiversity or biological diversity was for the first time determined in the context of approval of the new international nature protection instrument within the Summit of Earth of UNCED which took place in 1992 in Rio de Janeiro. It means variety of life on the earth and includes four levels of approach: variety of ecosystems, variety of types, genetic variety and ethnocultural diversity.

From the conceptual point of view the biodiversity has the value inherent in it, but at the same time it is associated as well with ecological, genetic, social, economic, scientific, educational, cultural, recreational and esthetic value.

The biodiversity represents first-priority condition of existence of human civilization and, thereby, provides system of maintenance of life and development of social and economic systems. Within natural and semi-natural ecosystems there is established intra specific and mezhduspetsifichesky connection through which the material, energy and information exchanges providing their performance, adaptability and flexibility are performed. These interrelations extremely complex, it is very difficult to estimate importance of each type in functioning of these systems and possible consequences of reducing their livestock/number or their disappearance to provide long-term survival of ecological systems – the key supplier of resources on whom development and wellbeing of mankind depends. That is why preserving biodiversity is very important to provide survival of any life forms including people.

Also the biodiversity role in ensuring the services provided by ecological systems as that is so important: regulation of soil climatic conditions, water purification, reducing consequences of natural disasters and so forth.

In 1995 the Republic of Moldova ratified the Convention on biological diversity (further – KBR) which provides preserving biological diversity, long-term use of its elements both the correct and fair separation of benefit from use of genetic resources and access to these resources, in view of all rights to appropriate resources and thanks to adequate financing of measures for preserving biodiversity.

Within the Conference of the Parties of KBR also the principles making basis of preserving biodiversity and long-term development of social and economic system as they are given below were approved:

1) principle of the prevention: the biodiversity remains effectively if consequences of possible threats are eliminated or mitigated;

2) principle of care: lack of exhaustive scientific research cannot be considered the basis to allow the activities fraught with essential negative impact on biodiversity;

3) the principle "Pays pollutant": the one who leads to destruction of biodiversity shall cover also the cost connected with the prevention, reduction of impact or with ecological recovery;

4) the principle of participation of the public in decision making and information access and to justice in the field of the environment: the public shall have access to nature protection information, it shall have the right to take part in decision making process, connected with ecology;

5) principle of sectoral integration: preserving biodiversity and long-term use of its components should be considered in decision making process and establishments sectoral the politician;

6) principle of ecosystem approach: represents the strategy of the integrated, adaptive management based on application of proper scientific methodologies which consider structure and functions of ecosystems and their capability to provide support;

7) principle of ecological networks: for ensuring communication between components of biodiversity and components of landscape and social structures, at the same time the main components the natural territories protected by the state serve, ecological corridors for communication are established.

As the framework convention KBR establishes only general measures of preserving and long-term use whereas for implementation of these regulations it is necessary to develop national strategies, plans or programs or to adapt already available, at the same time it is necessary to integrate preserving and long-term use bioraznoobaziya into the corresponding sectoral or intersectoral plans, programs and politicians.

For these reasons in 2001 the Parliament approved the first National strategy and the Action plan in preserving biological diversity (further – NSPD RBU). These two documents planned the main activities the next 10 years and mobilized the internal capacity of the country to the solution of topical problems. In NSPD RBU for 2001 implementation of 263 actions in case of financial support of about 19 million US dollars was planned, and the Ministry of Agriculture, regional development and the environment, the Academy of Sciences of Moldova, the Ministry of Education, culture and researches and the Moldsilva Agency were her main contractors.

Considerable part of the actions established in NSPD RBU was executed, and progress in implementation received reflection in five national reports on biological diversity (1999, 2001, 2005, 2010, 2014) which are published on the web page of RBU (www.cbd.int) and Office on biodiversity under the Ministry of Agriculture, regional development and the environment (http://bsapm.moldnet.md).

Though in the sphere of protection of biodiversity the significant progress was made (expansion of the natural territories protected by the state and the lands occupied with the woods, creation of national ecological network, ecological education of the population etc.), process of degradation of ecosystems and natural habitats was not suspended.

The main task of this Strategy – creation of conditions for improvement of quality of components of biological diversity by strengthening of basis for sustainable development of the country. Vision of RBU reflects desire of the Republic of Moldova in this sense as it is possible to approach closer the European standards and by that to achieve the eurointegration objectives. All priority directions of development fixed in Strategy are aimed at harmonization profile national the politician with the European.

Therefore, as a result of implementation of RBU at the national level provisions of international treaties will be performed, one of the parties of which is the Republic of Moldova, in particular, the recommendations enshrined in the Strategic plan on biodiversity for 201-2020 including for the purpose of Aichi on biodiversity approved in Nagoya (Japan) at the Conference of the Parties of KBR (2010), in the Strategic plan of the European Union across KBR till 2020, and also the international context of protection of vulnerable segments of the population and role of the woman in environmental protection and the long-term management of natural resources advanced by the UN.

Industry bodies of the central public management (The Ministry of Agriculture, regional development and the environment, the Ministry of Economy and Infrastructure, the Moldsilva Agency), Academy of Sciences of Moldova, bodies of local public authority, civil society (public associations, community, ordinary citizens) and the private sector (performing activities in the sphere of the industry, tourism, production of natural resources) will be beneficiaries of this Strategy.

II. Present condition

Section 1. Legislative and institutional system in the field of preserving biodiversity

1. Activities of the international community

The researches conducted in the last decade revealed new processes and tendencies of the changes happening in natural ecosystems as well as the reasons which are slowing down accomplishment of the purposes of KBR. At the 10th Conference of the Parties of KBR (Nagoya, Japan, 2010) were made historical decisions and specific objectives the next 10 years are approved (2011-2020) about establishment of urgent measures on mitigation which directly involve loss of biodiversity (reducing habitats, overexploitation of flora and fauna, pollution of natural ecosystems, invasion of alien types and climate change). During the meeting of the governments of the states which are sides of KBR the agreement on packet of specific measures which will provide such protection to ecosystems of the planet that they became platform for support of life and wellbeing of mankind for long time was reached.

2. Participation of the Republic of Moldova

This Strategy the Republic of Moldova takes active part in implementation of the Strategic plan on biodiversity (KBR) for 2011-2020, continuing reforms which were initiated in the past, in particular in ensuring compliance of implementation of the international obligations assumed by the Republic of Moldova in case of implementation of KBR to recommendations of other international conventions in the field of biodiversity on consolidation of institutional reform and the legal framework in the field of preserving biodiversity and to rational use of natural resources.

3. Legal and normative framework

The legal framework in the field of preserving and long-term use of biodiversity strong, however process of coordination of actions between sectors of national economy is very complicated. Enhancement of legislative framework by their reduction in compliance with the international experience is begun (in particular, with experience of neighboring countries from the European Union).

The agreement on association the European Union – the Republic of Moldova creates prerequisites for cooperation in various areas and will give the chance to approve political, economic and ecological systems of the Republic of Moldova with values and standards of the European Union. So, citizens of the Republic of Moldova will be able to take advantage of enhancement of legal framework in the field of the environment, health care, safety and judicial system which will correspond to the European legislation.

The legal basis in the field of preserving biodiversity includes the following legal acts:

1) the Land code No. 828-XII of December 25, 1991;

2) the Forest code No. 887-XIII of June 21, 1996;

3) the Law on environmental protection No. 1515-XII of June 16, 1993;

4) the Law on fauna No. 439-XIII of April 27, 1995;

5) the Law on natural resources No. 1102-XIII of February 6, 1997;
