About the Advisory committee concerning consumer protection of state members of the Eurasian Economic Union

According to Items 7 and 44of the Regulations on the Eurasian economic commission (appendix №1 to the Agreement on the Eurasian Economic Union of May 29, 2014), the subitem 3 of Item 6 of the Protocol on carrying out coordinated policy in the field of consumer protection (appendix №13 to the Agreement on the Eurasian Economic Union of May 29, 2014) the Board of the Eurasian economic commission decided:

1. Create the Advisory committee concerning consumer protection of state members of the Eurasian Economic Union.

2. Approve the enclosed Regulations on the Advisory committee concerning consumer protection of state members of the Eurasian Economic Union.

3. Determine that before adoption by the Supreme Eurasian economic council of the decision on fixing of functions of the Eurasian economic commission in the field of consumer protection of state members of the Eurasian Economic Union for the member of Board of the Eurasian economic commission of obligation of the chairman of the Advisory committee concerning consumer protection of state members of the Eurasian Economic Union are performed by the member of Board (Minister) of technical regulation of the Eurasian economic commission by Radicular V. N.

4. This Decision becomes effective after 30 calendar days from the date of its official publication.

Regulations on the Advisory committee concerning consumer protection of state members of the Eurasian Economic Union

I. General provisions

1. The advisory committee concerning consumer protection of state members of the Eurasian Economic Union (further – Committee) is created under Board of the Eurasian economic commission (further respectively – Board, the Commission) according to Items 7 and 44of the Regulations on the Eurasian economic commission (appendix № 1 to the Agreement on the Eurasian Economic Union of May 29, 2014) and the subitem 3 of Item 6 of the Protocol on carrying out coordinated policy in the field of consumer protection (appendix №13 to the Agreement on the Eurasian Economic Union of May 29, 2014).

The committee is the consultative body of the Commission providing preparation of offers, recommendations and carrying out consultations concerning realization with state members of the Eurasian Economic Union (further respectively – state members, the Union) coordinated policy in the field of consumer protection.

2. The committee in the activities is guided by the Agreement on the Eurasian Economic Union of May 29, 2014, other international treaties and acts constituting the right of the Union, the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, and also this Provision.

II. Main objectives and functions of Committee

3. The main objectives of Committee are:

a) carrying out consultations concerning forming of single approaches in carrying out coordinated policy in the field of consumer protection;

b) preparation of offers on interaction of authorized bodies in the field of consumer protection;

c) preparation of project proposals of recommendations of the Commission for state members in the field of consumer protection;

d) consideration of other questions in the field of consumer protection within carrying out consultations, including at the request of the member of Board within whose competence questions of consumer protection, and also preparation of offers on the specified questions are.

4. For realization of the tasks assigned to it the Committee performs the following functions:

a) participates in carrying out the analysis:

the international treaties and acts constituting the right of the Union, and also the legislation of state members;

law-enforcement practice of implementation of the legislation of state members in the field of consumer protection;

activities of the international organizations in the field of consumer protection and public associations of consumers;

b) prepares offers on the following questions:

harmonization of the legislation of state members in the field of consumer protection;

forming of effective mechanisms and development of the principles of carrying out by state members of coordinated policy in the field of consumer protection;

taking measures to suppression of activities of unfair business entities and non-admission of realization of low-quality goods (services) in the territories of state members;

the organization of cooperation between authorized bodies in the field of consumer protection, the international organizations in the field of consumer protection, public associations of consumers and the Commission;

enhancement of procedure for carrying out monitoring and control of execution by state members of provisions of the international treaties and acts constituting the right of the Union in the field of consumer protection;

c) performs cooperation on other questions in the field of consumer protection.

III. Structure of Committee

5. The structure of Committee is created of heads (deputy managers) of authorized bodies of the government of state members in the field of consumer protection.

For forming of structure of Committee the Board requests from state members of the offer on candidates for authorized representatives of public authorities of state members.

According to the offer of state members of Committee representatives of business community, scientific and public organizations, other independent experts can be included.

State members timely inform Board on need of replacement of authorized representatives of public authorities of state members for Committee, and also represent offers on modification of its structure.

The structure of Committee affirms the order of Board.

6. Presides over committee meetings and the member of Board within whose competence questions of consumer protection are (further – the chairman of Committee) performs the common directorship of work of Committee.

7. Chairman of Committee:

a) directs activities of Committee and will organize work on accomplishment of the tasks assigned to Committee;

b) approves and approves the agenda of committee meeting, determines date, time and the place of its carrying out;

c) conducts committee meetings;

d) approves protocols of committee meetings;

e) informs Board and Council of the Commission on the recommendations developed by Committee;
