1. Approve the enclosed Procedure for entering into the Eurasian economic commission of offers of state members of the Eurasian Economic Union on establishment of rates of import customs duties (including seasonal), the tariff quotas, cases and conditions of provision of the tariff privileges.

2. Recognize invalid:

The decision of the Commission of the Customs union of June 18, 2010 No. 308 "About Regulations of entering of offers on measures of regulation of foreign trade into the Commission of custom union";

The decision of the Commission of the Customs union of January 28, 2011 No. 531 "About Recommendations about preparation of the report following the results of consideration of matters of argument of customs and tariff regulation";

The decision of the Commission of the Customs union of March 2, 2011 No. 553 "About modification of Regulations of introduction of offers on measures of regulation of foreign trade of the Commission of the Customs union";

Item 3 of the Decision of Board of the Eurasian economic commission of March 31, 2015 No. 23 "About procedure for entering into the Eurasian economic commission and preparation by the Eurasian economic commission of offers on introduction or cancellation of single measures of non-tariff regulation".

3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

Procedure for entering into the Eurasian economic commission of offers of state members of the Eurasian Economic Union on establishment of rates of import customs duties (including seasonal), the tariff quotas, cases and conditions of provision of the tariff privileges

1. This Procedure is developed according to Item 43 of the Regulations on the Eurasian economic commission (appendix No. 1 to the Agreement on the Eurasian Economic Union of May 29, 2014), for the purpose of ensuring realization of Item 64 of the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98 (further – Regulations), and determines the procedure of entering into the Eurasian economic commission (further – the Commission) offers of state members of the Eurasian Economic Union on establishment of rates of import customs duties (including seasonal), the tariff quotas, cases and conditions of provision of the tariff privileges (further respectively – the offer, measures of customs and tariff regulation).

2. The offer is made in the Commission by the public authority of state member of the Eurasian Economic Union authorized according to the legislation of this state on interaction with the Commission (further respectively – authorized body, state member, the Union).

3. The offer shall contain:

a) the appeal of state member to the Commission on form according to appendix No. 1;

b) drafts of acts of bodies of the Union.

If disaggregation of code of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union (further – the CN FEA EEU) containing in Explanations to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union or inclusion in the CN FEA EEU of the additional note of the Union is provided in the draft decision of the Commission and also if it is necessary to include the explaining provisions concerning the allocated line item of the CN FEA EEU in the specified Explanations, then the offer shall contain also the draft of the recommendation of Board of the Commission of modification of these Explanations;

c) the explanatory note containing the following information (on each 10-unit line item of the CN FEA EEU in which the goods concerning which it is offered to enter measure of customs and tariff regulation are classified):

the description of goods with indication of its properties, characteristics, functional purpose and the field of use;

data on the main consumers or customer groups of goods. If the goods are used for production of other goods, the cost portion of goods concerning which it is offered to enter measure of customs and tariff regulation, in average market value of manufactured goods is specified;

the comparative characteristic of the goods made in the territory of state member with the similar goods made in the third countries (in case of production of similar goods in the territory of the Union) (in the presence of opportunity);

the description and the characteristic, including quantitative and cost, the market of goods (in the presence of opportunity).

d) statistical data in form according to appendix No. 2;

e) the financial and economic reasons for drafts of decisions of the Commission containing the description of economic effect of implementation of the decision, assessment of possible influence of the decision on state member budget receipts, structure and export volume and import of state member, economic activity of national subjects of the market;

e) other documents and data which matter for acceptance by bodies of the Union of the decision for the considered offer, the financial and economic calculations reflecting social and economic efficiency of introduction of proposed measure of customs and tariff regulation (in the presence of opportunity).

4. If the offer provides modification of the CN FEA EEU at the level of the 10th category of specification symbol, then it also shall contain the following information:

a) criteria (classification signs) according to which these goods (type of goods) can be unambiguously allocated from set of similar goods;
