1. Approve the enclosed Rules of the admission of civil aviation organizations of the Republic of Kazakhstan to application of aviation standards of the international organizations in the field of civil aviation.

2. To committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printed publicity materials and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising Vice-Minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of the admission of civil aviation organizations of the Republic of Kazakhstan to application of aviation standards of the international organizations in the field of civil aviation

1. General provisions

1. These rules of the admission of civil aviation organizations of the Republic of Kazakhstan to application of aviation standards of the international organizations in the field of civil aviation (further - Rules) are developed according to the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and determine procedure for the admission of civil aviation organizations of the Republic of Kazakhstan to application of aviation standards of the international organizations in the field of civil aviation.

2. Rules do not extend to air vehicles of the state and experimental aircraft.

3. In the territory of the Republic of Kazakhstan the aviation standards of the international organizations in the field of civil aviation determined by authorized body in the field of civil aviation are applied (further - authorized body).

The declared aviation standard is the aviation standard of the international organization in the field of civil aviation declared by civil aviation organization.

2. Procedure for the admission of civil aviation organizations of the Republic of Kazakhstan to application of aviation standards of the international organizations in the field of civil aviation

4. For the admission to application of the declared aviation standards civil aviation organization (further - the applicant) directs to authorized body the application in any form.

The following documents are enclosed to the application:

1) the copy of the air operator certificate of civil air vehicles (the certificate on the right of accomplishment of flights or aerial works) or the copy of the certificate of the organization for maintenance and repair of equipment of civil aviation;

2) copies of documents on operation of the air vehicles registered in the state in which the declared aviation standards and which provides control of maintenance of the flight validity are applied (for the applicant who is the operator of civil air vehicles);

3) the copy of the description of the organizational structure meeting the declared aviation standards;

4) copies of results of assessment of the audit on compliance to application of the declared aviation standards which is carried out by independent international auditing organization;

5) copies of documents on maintenance of the flight validity and (or) maintenance performance of air vehicles according to requirements of the declared aviation standards;

6) managements on:

to production of flights;

to procedures of the organization of maintenance of air vehicles and repair of aviation engineering of the operator providing also inspection (control) of flight operation, technical condition and the equipment;

to carrying out training of aeronautical personnel according to the declared aviation standards;

7) copies of documents on safety management system of flights;

8) copies of documents on quality control system.

All above-stated copies of documents are certified by the sign and seal of the applicant.

5. The basis for the admission to application of the declared aviation standards is the decision of authorized body made in time no more than thirty calendar days.

6. In case of the positive decision the authorized body in writing notifies the applicant on the admission to application of the declared aviation standards which is not limited on valid time.

7. The refusal in issue of the admission is made in cases if:

1) the documents submitted by the applicant do not conform to requirements of item 4 of Rules;

2) the services (work types) rendered by the applicant do not conform to requirements of the aviation standards declared to application.

8. In case of refusal in issue of the admission to application of the declared aviation standards the applicant is given the motivated answer in writing with indication of causes of failure.
