About approval of Rules of the organization of protection of bulk distribution lines

1. Approve the enclosed Rules of the organization of protection of bulk distribution lines.

2. To provide to development department of the oil industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of the copy of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising Vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of the organization of protection of bulk distribution lines

1. General provisions

1. These rules of the organization of protection of bulk distribution lines (further - Rules) are developed according to the subitem 5) of article 6 of the Law of the Republic of Kazakhstan of June 22, 2012 "About the bulk distribution line" and determine procedure for the organization of protection of bulk distribution lines.

2. The basic concepts applied in these rules:

1) the protected object - the property which is under protection (devices, the equipment, structures, buildings and other constructions with the parcels of land occupied by them) entering single production and technology complex of the bulk distribution line;

2) the bulk distribution line - the single production and technology complex consisting of the linear part and objects providing safe transportation of products, conforming to requirements of technical regulations and national standards;

3) protection of the bulk distribution line - system of the actions directed to prevention of illegal actions of persons concerning the bulk distribution line and also protection of technical means of protection and safety against intentional inactivation;

4) the conservation zone of the bulk distribution line - the territory (on the land and (or) water) with special conditions of protection and use, adjacent to objects of the bulk distribution line and intended for safety of the population and creation of necessary conditions for safe and uninterrupted operation of objects of the pipeline within which the types of activity incompatible with the purposes of its establishment are limited or prohibited;

5) owner of the bulk distribution line - The Republic of Kazakhstan, administrative and territorial unit of the Republic of Kazakhstan or the legal entity owning the bulk distribution line on the property right;

6) physical safety of the bulk distribution line - condition of security of the bulk distribution line from threats which sources are illegal actions of persons;

7) physical protection of the bulk distribution line - set of the precepts of law, organizational measures and technical decisions directed to prevention of threats concerning the bulk distribution line which sources are the illegal actions of persons involving damages;

8) the operator - the owner of the bulk distribution line or the legal entity owning the bulk distribution line on other legal cause, the performing transportations of products through the bulk distribution line and (or) its operation or the organization authorized by them rendering operator services;

9) products - oil, including stable (unstable) gas condensate, natural gas, associated gas, other liquid and gaseous hydrocarbons, oil products prepared for transportation and corresponding to technical regulations by the corresponding type of products.

2. Procedure for the organization of protection of bulk distribution lines

4. The organization of protection of bulk distribution lines provides:

1) implementation and providing throughput and in object the modes on the protected objects;

2) interaction with security service of the owner of the bulk distribution line (operator);

3) exposure of posts of protection, mobile groups, groups of rapid response;

4) control of actions of personnel, visitors of the protected objects;

5) suppression of illegal actions concerning the protected objects;

6) implementation of technical means of protection and safety;

7) response of forces of protection to signals of operation of technical means of protection and safety.

5. Activities for protection of the bulk distribution line on Frontier and within borderland are performed according to the procedure, determined by the Law of the Republic of Kazakhstan of January 16, 2013 "About Frontier of the Republic of Kazakhstan".

6. Protection of the bulk distribution line is performed by the subject of security activities on the basis of the agreement on rendering security services.

7. The agreement on rendering security services is signed between the owner of the bulk distribution line (operator) and the subject of security activities.

Rendering security services on the basis of the agreement on rendering security services is regulated by the Law of the Republic of Kazakhstan of October 19, 2000 "About security activities".
