About approval of Rules of limiting approval of rate for electrical energy and limiting rate for service in maintenance of readiness of electric power

1. Approve the enclosed Rules of limiting approval of rate for electrical energy, limiting rate for the balancing electric power and limiting rate for service in maintenance of readiness of electric power.

2. To provide to department of power industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising Vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective since January 1, 2018, except for Items 3, of 7, of 8, of 9, of 10, of 11, of 12, of 13 and 14 Rules which become effective since January 1, 2019.

Rules of limiting approval of rate for electrical energy, limiting rate for the balancing electric power and limiting rate for service in maintenance of readiness of electric power

Chapter 1. General provisions

1. These rules of limiting approval of rate for electrical energy and limiting rate for service in maintenance of readiness of electric power (further - Rules) are developed according to the subitem 247) of Item 15 of the Regulations on the Department of Energy of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of September 19, 2014 No. 994 (further - the Provision), and determine limiting approval procedure of rate for electrical energy and limiting rate for service in maintenance of readiness of electric power.

2. In these rules the following basic concepts are used:

3) authorized body - the state body performing management in the field of power industry;

Limiting 4) rate for service in maintenance of readiness of electric power - the approved by authorized body for the term equal to seven years, maximum size of rate (price) of service in maintenance of readiness of electric power for all operating power making organizations (except for amounts of service in maintenance of readiness of electric power when which rendering the operating power making organizations and winners of the tender for construction of the generating installations which are again put into operation and also winners of biddings use the individual rate for service in maintenance of readiness of electric power established by authorized body);

5) selling price of electrical energy from the power making organization - the selling price of electrical energy of the power making organization included in the corresponding group of the power making organizations realizing electrical energy, which is not exceeding its limiting rate for electrical energy increased by the corresponding hour rates determined according to the procedure, established by authorized body according to the subitem 247) of Provision Item 15.

Limiting 6) rate for electrical energy - the monetary value of cost of the developed electrical energy approved by authorized body each seven years the power making organization included in group of the power making organizations realizing electrical energy, consisting of production costs of the electrical energy and profit margin determined by the technique established by authorized body.

Chapter 2. Limiting approval procedure of rate for electrical energy

3. Limiting rates for electrical energy affirm on groups of the power making organizations realizing electrical energy, each seven years with breakdown by years and if necessary are adjusted.

4. The authorized body approves groups of the power making organizations realizing electrical energy according to the subitem 246) of Provision Item 15.

5. Groups of the power making organizations realizing electrical energy are created by the following criteria: type of the power making organizations, installed capacity, type of the used fuel, remoteness from the location of fuel, arrangement in one part of single electric utility system of the Republic of Kazakhstan in which there are no restrictions of technical nature for transfer of electrical energy.

By criteria:

1) "type of the power making organizations" the power making organizations are divided on:

the power making organizations which part condensation power plants are;

the power making organizations which part heating power plants are;

the power making organizations which part gas turbine power plants are;

the power making organizations which part steam-gas power plants are;

the power making organizations which part hydraulic power plants are;

the power making organizations which part gas-piston power plants are;
