About approval of Rules of provision in use of historical and cultural monuments of the international and republican value

According to subitem 14-6) of article 19 of the Law of the Republic of Kazakhstan of July 2, 1992 "About protection and use of objects of historical and cultural heritage" I ORDER:

1. Approve the enclosed Rules of provision in use of historical and cultural monuments of the international and republican value.

2. For culture and art of the Ministry of Culture and sport of the Republic of Kazakhstan in the procedure established by the legislation to provide to department:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let;

3) after official publication placement of this order on Internet resource of the Ministry of Culture and sport of the Republic of Kazakhstan;

4) submission to Department of legal service of the Ministry of Culture and sport of the Republic of Kazakhstan of data on execution of the actions provided by this Item within ten working days from the date of execution of actions.

3. To impose control of execution of this order on the vice-Minister for Culture and Sports of the Republic of Kazakhstan G. Akhmedyarov.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of provision in use of historical and cultural monuments of the international and republican value

1. These rules of provision in use of historical and cultural monuments of the international and republican value determine procedure for provision in use of historical and cultural monuments of the international and republican value (further - monuments).

2. The monuments which are state-owned property of the Republic of Kazakhstan are used for the purpose of revival and development of spiritual and cultural traditions of the people of Kazakhstan, and also in the scientific and educational purposes according to article 29 of the Law of the Republic of Kazakhstan of July 2, 1992 "About protection and use of objects of historical and cultural heritage".

3. For obtaining in use of monument physical persons and legal entities (further - applicants) represent to authorized body on protection and use of objects of historical and cultural heritage (further - authorized body) the following documents:

for physical persons:

1) the statement in form, according to appendix to these rules;

2) notarially attested copy of the identity certificate;

for legal entities:

1) the statement in form, according to appendix to these rules;

2) reference or notarially attested copy of the certificate on state registration (re-registration) of the legal entity.

4. The documents specified in Item 3 of these rules are considered by authorized body within fifteen working days from the date of their receipt.

Following the results of consideration of documents the authorized body makes the decision on provision in use of monument or refuses provision in use of monument.

5. In case of decision making about provision in use of monument, to the applicant in time, specified in item 4 of these rules, the written notice and the draft agreement goes for provision in use of monument.

The contract for provision in use of monument is signed between authorized body and the applicant according to Item 10 of article 74 of the Law of the Republic of Kazakhstan of March 1, 2011 "About state-owned property" within fifteen calendar days from the date of receipt of the notification of the applicant.

6. In case of refusal in provision in use of monument, to the applicant the written motivated answer in time specified in item 4 of these rules goes.

7. The bases for refusal in representation in use of monument are:

1) representation by the applicant of the documents which are not corresponding to Item 3 of these rules;

2) finding of the declared monument in use;

3) if the purpose of use of monument is not answered the requirement of article 29 of the Law of the Republic of Kazakhstan of July 2, 1992 "About protection and use of objects of historical and cultural heritage".
