1. Approve the enclosed Rules of accounting and registration of the hunting predatory birds used on hunting.

2. To provide to committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of accounting and registration of the hunting predatory birds used on hunting

Chapter 1. General provisions

1. These rules of accounting and registration of the hunting predatory birds used on hunting (further - Rules), are developed according to the subitem 70) of Item 1 of article 9 of the Law of the Republic of Kazakhstan of July 9, 2004 "About protection, reproduction and use of fauna" and determine procedure for accounting and registration of the hunting predatory birds used on hunting.

2. The hunting predatory birds used on hunting for the territories of the Republic of Kazakhstan are subject to accounting and registration in republican association of public associations of hunters and subjects of hunting (further - association), except temporarily imported for a period of up to three months.

Chapter 2. Procedure for accounting and registration of the hunting predatory birds used on hunting

3. Accounting and registration of the hunting predatory birds used on hunting (further - hunting predatory birds), is performed by association.

4. For accounting and registration of hunting predatory bird are represented:

1) the statement of physical person or legal entity in form, according to appendix 1 to these rules, with indication of type of hunting predatory bird, its floor, year of birth, the expected period of content, the place and method of acquisition of hunting predatory bird, availability of rings or microchips, passport data and the applicant's address;

2) the documents confirming legality of acquisition of hunting predatory bird (the copy of permission to withdrawal, the purchase and sale agreement, the receipt and (or) the payment document) and the passport of hunting predatory bird which is drawn up addressed to the former owner;

3) copy of the certificate of the hunter;

4) the copy of the document of the physical person proving the identity, the copy of the reference (the certificate *) about the state registration (re-registration) of the legal entity.

Note: the certificate * about the state (accounting) registration (re-registration) of the legal entity (branch, representation), issued before enforcement of the Law of the Republic of Kazakhstan of December 24, 2012 "About modification and amendments in some legal acts of the Republic of Kazakhstan concerning the state registration of legal entities and accounting registration of branches and representations", is valid before the termination of activities of the legal entity.

5. Execution of passports of the hunting predatory birds who are in the birthplace is made before the termination of calendar year of the birth, but no later than the beginning of hunting with them.

The passport is the document certifying legality of permanent content of hunting predatory bird and her registration, made by association.

6. The association verifies on compliance of type (sex, age) and the description of hunting predatory birds, their tags, on availability of conditions for content of hunting predatory birds. Hunting predatory birds for permanent content are marked with fixed rings or microchips.

7. Registration of hunting predatory bird is not made in cases of unlawful taking or illegal acquisition.

8. The passport of hunting predatory bird which is drawn up in form according to appendix 2 to these rules is issued by association within 5 (five) working days from the moment of registration of a statement.

9. On each hunting predatory bird the accounting card of hunting predatory bird in form, according to appendix 3 to these rules is filled in.

10. Data on hunting predatory bird and her owner are registered registration of hunting predatory birds in form, according to appendix 4 to these rules.

11. In case of use of the registered hunting predatory bird for hunting, in the certificate of the hunter record with indication of type of hunting predatory bird, number of fixed ring or the microchip, passport number is performed.

12. In case of change of residence of the owner or change of the owner of hunting predatory bird within 5 (five) working days its owner files documents according to item 4 of these rules to association for address modification and (or) renewal of the passport.
