The intergovernmental agreement on network of Asian highways

of April 26, 2004

Contracting parties,

understanding need of stimulation and development of the international motor transportations in Asia and between Asia and the neighboring regions,

in view of cooperation between member countries of the Economic and Social Commission for Asia and the Pacific of the United Nations in forming and putting into operation of network of Asian highways,

believing that for strengthening of ties and development of international trade and tourism between members of the Economic and Social Commission for Asia and the Pacific of the United Nations it is necessary to develop network of Asian highways according to requirements to international carriages and environmental protection, considering implementation in practice of effective international intermodal transports,

continuing to make common efforts on planning, development and enhancement of the international motor transportations in Asia and between Asia and the neighboring regions,

agreed as follows:

Article 1 Approval of Network of Asian highways

The contracting parties called further by the Parties approve the offered highway network which is referred to as below "network of Asian highways" which description is given in appendix I to this agreement, as the coordinated development plan for routes of the highways having the international value which they intend to carry out within the interstate programs.

Article 2 Determination of Network of Asian highways

The network of Asian highways described in appendix I includes the routes of the international value running in Asia, including roads, considerable part the crossing more than one subregion; the routes passing across subregions including the routes connecting them to the neighboring subregions and the routes of highways passing on state members of the Economic and Social Commission for Asia and the Pacific of the United Nations.

Article 3 Development of Network of Asian highways

Routes of network of Asian highways are brought into accord with the classification and regulations of designing given in appendix II to this agreement.

Article 4 Designation of Routes of network of Asian highways

1. Routes of network of Asian highways are designated by route sign which description is given in appendix III to this agreement.

2. The route signs corresponding to the sign described in appendix III to this agreement are established on all routes of network of Asian highways during five (5) years from the date of entry into force of this agreement concerning the relevant state according to Article 6 provisions.

Article 5 Procedure of the Signature of This Agreement and Receipt of the Status of His Participant

1. This agreement is open for signing by the states which are members of the Economic and Social Commission for Asia and the Pacific of the United Nations, from April 26 to April 28, 2004 in Shanghai, China, and then from May 1, 2004 to December 31, 2005 in the Central organizations of the United Nations in New York.

2. These states can become Participants of this agreement in the way:

a) final signing;

b) signings with condition of ratification, acceptance or approval which ratification, acceptance or approval follows; or

c) accessions.

3. Ratification, acceptance, approval or accession is performed by delivery on storage to the Secretary general of the United Nations of the document constituted in due form.

The article 6 Introduction of This Agreement in force

1. This agreement becomes effective for the ninetieth day from that day in which the governments at least to eight (8) the states will agree to be connected by the Agreement according to Item 2 of Article 5.

2. Concerning each state which will finally sign or will check the document on ratification, acceptance, approval or accession after date since which conditions of the introduction of the Agreement in force are met, the Agreement becomes effective for this state after ninety (90) days from the date of final signing by it or delivery by it on storage of this document.

Article 7 Working group on Asian highways

1. For consideration of the course of implementation of the Agreement and for consideration of any proposed amendments the Economic and Social Commission for Asia and the Pacific of the United Nations creates the Working group on Asian highways. Workgroup members are all state members of the Economic and Social Commission for Asia and the Pacific of the United Nations.

2. The working group holds the meetings every two years. Any Party can also, by means of the notification addressed to the secretariat to appeal to convene special meeting of the Working group. The secretariat notifies all workgroup members on the arrived request and convenes special meeting of the Working group if at least one thirds of the Parties let know about the consent with request during the period of four (4) months from the date of the notification the secretariat.

Article 8 Procedure of Amending the Main Text of This Agreement

1. Amendments according to the procedures specified in this Article can be made to the main text of this agreement.

2. Amendments to this agreement can be made by any Party.

3. The text of any proposed amendment extends the secretariat among all workgroup members on Asian highways at least for forty five (45) days prior to meeting of the Working group at which it is offered to be accepted.

4. The amendment is adopted by the Working group on Asian highways the majority to two thirds of attendees and the Parties participating in vote. The secretariat sends the adopted amendment to the Secretary general of the United Nations who extends it among all Parties for its acceptance.
