1. Approve the enclosed National plan for the prevention of oil spills and response to them in the sea and internal reservoirs of the Republic of Kazakhstan.

2. To provide to development department of the oil industry of the Department of Energy of the Republic of Kazakhstan in the procedure for the Republic of Kazakhstan established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of the copy of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Section 1. General provisions

1. The purposes and tasks of the National plan for the prevention of oil spills and to response to them in the sea and internal reservoirs of the Republic of Kazakhstan

The national plan for the prevention of oil spills and response to them in the sea and internal reservoirs of the Republic of Kazakhstan (further - the National plan) is developed according to subitem 23-7) of article 18 of the Law of the Republic of Kazakhstan of June 24, 2010 "About subsoil and subsurface use" (further - the Law "About Subsoil and Subsurface Use"),

The purpose of the National plan is creation of national system of ensuring rapid, effective and qualified response to oil spills in the sea and internal reservoirs (further - oil spill) the Republic of Kazakhstan, defiant pollution of ecological nature, and accomplishment of the corresponding transactions on liquidation of their effects.

3. Tasks of the National plan are:

1) providing timely, complex and effective measures of readiness and response to the emergency oil spills which are attracting or entailed damnification to the environment based on risks assessment and environmental impact assessment;

2) determination of powers and order of interaction of the central executive bodies, local executive bodies, other interested organizations and organizations, and also the subsoil users performing oil operations (further - the subsoil user), and the physical persons and legal entities performing the activities at the sea and internal reservoirs connected with risk of oil spill;

3) ensuring interaction of the national plan and state system of civil protection.

4. Ensuring safe operation of production facilities for the purpose of non-admission of oil spill in the Republic of Kazakhstan in case of accidents, incidents, protection of the population, subjects to managing and the territory of the country against impact of the striking (destroying) factors of emergency situations is performed according to the Ecological code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "About subsoil and subsurface use", the Law of the Republic of Kazakhstan of April 11, 2014 "About civil protection" (further - the Law "About Civil Protection"), the Law of the Republic of Kazakhstan of January 17, 2002 "About merchant shipping" (further - the Law "About Merchant Shipping") and international treaties of the Republic of Kazakhstan.

5. The concepts applied in the National plan correspond to the concepts used in the field of the legislation of the Republic of Kazakhstan on subsoil and subsurface use.

2. Sphere and scope of the National plan

6. Requirements of this National plan are applied also to the physical persons and legal entities performing the activities at the sea and internal reservoirs connected with risk of oil spill on such objects as trunk oil pipelines, sea constructions and seaports.

Requirements of this National plan are applied to courts and shipowners if other is not established by the Law of the Republic of Kazakhstan "About merchant shipping" and international treaties of the Republic of Kazakhstan.

7. The national plan acts on all territory of the Republic of Kazakhstan, including in waters of the Caspian and Aral seas within the borders defined by international treaties, internal reservoirs and coastal zones.
