General requirements to procedure for development and adoption of legal acts about regulation in the sphere of purchases, to contents of the specified acts and ensuring their execution

1. This document determines general requirements to procedure for development and acceptance, content, ensuring execution of the following legal acts:

a) The governments of the Russian Federation, approving:

general rules of determination of requirements to the separate types of goods, works, services (including marginal prices of goods, works, services) which are purchased by customers;

general rules of determination of standard costs on ensuring functions of state bodies, governing bodies of state non-budgetary funds, the municipal authorities determined according to the Budget code of the Russian Federation of the most significant organizations of science, education, culture and health care (including respectively territorial authorities and subordinated state organizations), State Atomic Energy Corporation "Rosatom", the State corporation on space activities Roskosmos and the organizations subordinated to them;

b) The governments of the Russian Federation, the supreme executive bodies of the government of subjects of the Russian Federation and local administrations claiming:

requirements to procedure for development and adoption of legal acts about regulation in the sphere of purchases, to contents of the specified acts and ensuring their execution;

rules of determination of requirements to the purchased state bodies, governing bodies of the state non-budgetary funds, municipal authorities determined according to the Budget code of the Russian Federation the most significant organizations of science, education, culture and health care according to their territorial authorities and state organizations, budgetary institutions and the unitary enterprises, and also State Atomic Energy Corporation "Rosatom", the State corporation subordinated to them on space activities Roskosmos and the organizations subordinated to them to separate types of goods, works, services (including marginal prices of goods, works, services);

rules of determination of standard costs on ensuring functions of state bodies, governing bodies of state non-budgetary funds, the municipal authorities determined according to the Budget code of the Russian Federation of the most significant organizations of science, education, culture and health care (including respectively territorial authorities and subordinated state organizations), and also State Atomic Energy Corporation "Rosatom", the State corporation on space activities Roskosmos and the organizations subordinated to them;

c) state bodies, governing bodies of state non-budgetary funds, municipal authorities determined according to the Budget code of the Russian Federation of the most significant organizations of science, the education, culture and health care, State Atomic Energy Corporation "Rosatom", State corporation on space activities Roskosmos claiming:

standard costs on ensuring functions of state bodies, governing bodies of state non-budgetary funds, the municipal authorities determined according to the Budget code of the Russian Federation of the most significant organizations of science, education, culture and health care (including respectively territorial authorities and subordinated state organizations), and also State Atomic Energy Corporation "Rosatom", the State corporation on space activities Roskosmos and the organizations subordinated to them;

2. The legal acts specified in subitems "an" and "b" of Item 1 of this document are developed in the form of projects of regulatory legal acts (municipal legal acts).

3. State bodies, governing bodies of state non-budgetary funds and municipal authorities have the right to discuss previously drafts of legal acts, the specified in paragraphs three of the subitem "b" and the paragraph third the subitem "v" of Item 1 of this document, at meetings of public councils under the specified bodies.

4. General rules of determination of requirements to the separate types of goods, works, services (including marginal prices of goods, works, services) which are purchased by customers shall:

a) contain procedure for forming and approval by the Government of the Russian Federation, the supreme executive body of the government of the subject of the Russian Federation, local administration of the list of separate types of goods, works, services (further - the list), requirements to which consumer properties (including to characteristics of quality) and to other characteristics (including marginal prices) state bodies, governing bodies of state non-budgetary funds, the municipal authorities determined according to the Budget code of the Russian Federation the most significant organizations of science, education, culture and health care, State Atomic Energy Corporation "Rosatom", the State corporation by space activities Roskosmos determining establish:

structure of information included in the list;

procedure for application of the All-Russian Product Classifier by types of economic activity when forming the list;

procedure for the choice of consumer properties (including characteristics of quality) and other characteristics of the purchased goods, works, services concerning which it is required to establish normative values;

requirements to measure definition, characterizing consumer properties (including characteristics of quality) and other characteristics (including marginal prices) the purchased goods, works, services;

the criteria applied in case of selection of separate types of goods, works, services to inclusion in the list;
