Requirements to procedure for development and adoption of legal acts about regulation in the sphere of purchases for ensuring federal needs, to contents of the specified acts and ensuring their execution

1. This document determines requirements to procedure for development and acceptance, content, ensuring execution of the following legal acts:

a) The governments of the Russian Federation, approving:

rules of determination of standard costs on ensuring functions of federal state bodies, the governing bodies of state non-budgetary funds of the Russian Federation determined according to the Budget code of the Russian Federation of the most significant organizations of science, education, culture and health care (including respectively territorial authorities and subordinated state organizations), and also State Atomic Energy Corporation "Rosatom", the State corporation on space activities Roskosmos (and the organizations subordinated to them) (further - standard costs);

rules of determination of requirements to the separate types of goods, works, services (including marginal prices of goods, works, services) which are purchased for ensuring federal needs;

b) federal state bodies, governing bodies of state non-budgetary funds of the Russian Federation determined according to the Budget code of the Russian Federation of the most significant organizations of science, the education, culture and health care, State Atomic Energy Corporation "Rosatom", State corporation on space activities Roskosmos (further - customers) claiming:

standard costs;

requirements to the separate types of goods, works, services (including marginal prices of goods, works, services) which are purchased by the customer, its territorial authorities (divisions) and state organizations, budgetary institutions, the unitary enterprises, and also the organizations subordinated to it specified in the paragraph the second the subitem "an" of this Item (further respectively - territorial authorities (divisions) and the subordinated organizations).

2. The legal acts specified in the subitem "an" of Item 1 of this document are developed by the Ministry of Finance of the Russian Federation in coordination with Federal Antimonopoly Service in the form of drafts of orders of the Government of the Russian Federation.

3. The legal acts specified in the subitem "b" of Item 1 of this document can provide managerial right (deputy manager) of federal state body, governing body of state non-budgetary funds of the Russian Federation to approve standard rates of quantity and (or) standard rates of the price of goods, works, services.

4. Customers if the specified bodies are not at the same time subjects of budgetary planning, approve drafts of the legal acts specified in the subitem "b" of Item 1 of this document with subjects of budgetary planning under which authority they are.

5. For carrying out discussion for the purpose of public control of drafts of the legal acts specified in Item 1 of this document, according to Item 6 of general requirements to procedure for development and adoption of legal acts about regulation in the sphere of purchases, to contents of the specified acts and ensuring their execution approved by the order of the Government of the Russian Federation of May 18, 2015 No. 476 "About approval of general requirements to procedure for development and adoption of legal acts about regulation in the sphere of purchases, to contents of the specified acts and ensuring their execution" (further respectively - general requirements, discussion for the purpose of public control), customers place drafts of the specified legal acts and explanatory notes to them in accordance with the established procedure in unified information system in the sphere of purchases.

6. The term of carrying out discussion for the purpose of public control is established by federal state bodies, governing bodies of state non-budgetary funds of the Russian Federation and there cannot be less than 5 working days from the date of placement of drafts of the legal acts specified in Item 1 of this document, in unified information system in the sphere of purchases.

7. Customers consider the offers of public associations, legal entities and physical persons which arrived in electronic or written form in time, established by the specified bodies taking into account provisions of Item 6 of this document.

8. Customers no later than 30 working days from the date of the expiration specified in Item 6 of this document place in unified information system in the sphere of purchases the protocol of discussion for the purpose of public control which shall contain information on accounting of the arrived offers of public associations, legal entities and physical persons and (or) reasonable line item of federal state body, governing body of state non-budgetary funds of the Russian Federation on impossibility of accounting of the arrived offers.

9. By results of discussion for the purpose of public control customers if necessary make decisions on modification of drafts of the legal acts specified in Item 1 of this document.
