About approval of the Procedure for import to customs area of the Republic of Tajikistan of products of the subject obligatory certification

According to part 2 of article 29 of the Law of the Republic of Tajikistan "About assessments of conformity",

Rasporyazhayem:

1. Approve the Procedure for import to customs area of the Republic of Tajikistan of products which are subject to obligatory certification it (is applied).

2. Provide this Order on state registration in the Ministry of Justice of the Republic of Tajikistan.

3. Enter in operation this Order after state registration and official publication.

4. Declare invalid the order of Customs Service under the Government of the Republic of Tajikistan of September 20, 1999 No. 240 "About approval of joint Order of interaction of the organizations and departments in case of the customs clearance and goods control which are subject to obligatory certification".

Procedure for import to customs area of the Republic of Tajikistan of products, subjects of obligatory certification

1. General provisions

1. This Procedure (further - the Procedure) is developed based on part 2 of article 29 of the Law of the Republic of Tajikistan "About assessment of conformity" and determines procedure for import to customs area of the Republic of Tajikistan of products, subjects of obligatory certification.

2. The certificate of conformity - the document certifying compliance of object of assessment of conformity to requirements of technical regulations and to documents in the field of standardization. Receipt of the certificate of conformity confirms safety and quality of the imported products. The specified certificate can be also the certificate on recognition of the foreign certificate of conformity.

3. Products, imported on customs area of the Republic of Tajikistan for free circulation according to the Inventory (works, services) which are subject to obligatory certification, the approved order of the Government of the Republic of Tajikistan of June 18, 2012 No. 310 are subject to obligatory confirmation of conformity.

4. The certificate of conformity is drawn up and issued by the authorized bodies of certification included in the Register of the state accreditation system of the Republic of Tajikistan.

5. Products subject to obligatory certification, are subject to conditional release without provision of the certificate of conformity, but in case of the obligation of the customs applicant about its representations to customs authority during the term provided by Items 12 and 13 of this Procedure.

6. Conditionally turned out products are under customs control. On conditionally issued products, subject to obligatory certification the prohibition on their realization (use) in any form before provision of the certificate of conformity, in the terms established by this Procedure is imposed.

7. Realization (use) of the imported products, subjects of obligatory certification is made only in the presence of the certificate of conformity.

8. It is forbidden to transfer to the third parties, including by sale or alienation different way conditionally turned out products.

9. The certificate of conformity is issued by rules of national system of certification of the Republic of Tajikistan. The certificate is drawn up and issued in one copy on products, batch of one name, or on group of homogeneous products.

10. The authorized body in the field of assessment of conformity after receipt of the notification on the arrived products to examine, sampling and samples of the declared products, identification of samples and their testing, the analysis of the received results of testing and decision making about issue or refusal in issue of the certificate of conformity.

11. Survey of the imported products, sampling and samples of these products for the purposes of certification is performed by body in the field of assessment of conformity in the presence of the representative of customs authority with participation of the owner of products or his representative. By results of survey the Sampling report which is signed by the present parties is in duplicate drawn up. One copy of the Act is handed to the owner of products or his representative, another remains at the representative of body in the field of assessment of conformity. In the act the quantity and mass of the selected samples (tests) is fixed.

12. The term of issue of the certificate of conformity by body in the field of assessment of conformity shall not exceed 3 working days, and on perishable products no more than 2 working days.

13. The maximum term for issue of the certificate of conformity, in cases when for certified works more than 3 product names or terms of sampling and tests are provided are not approved between the applicant and the specialist or it is necessary to carry out additional testing, shall not exceed 7 working days.

2. The sequence of the customs procedures in case of registration of conditional production which are subject to obligatory certification

14. The basis for conditional production, subject to obligatory certification customs payment and the obligation of the customs applicant or customs broker about provision of the certificate of conformity during the terms provided by Items 12 and 13 of this Procedure is. The decision on possibility of conditional production is made by the chief of customs or the official of customs authority it authorized.

15. The decision on conditional release is made on products, imported on customs area of the Republic of Tajikistan after conducting border control and other types of the state control in the place of their arrival.
