About the Concept of forming of the total electrical power market of the Eurasian Economic Union

1. Approve the enclosed Concept of forming of the total electrical power market of the Eurasian Economic Union.
2. In case of development of the program of forming of the total electrical power market of the Eurasian Economic Union to consider special opinion of the Republic of Belarus it (is applied).

This Concept is developed for the purpose of realization of Item 2 of article 81 of the Agreement on the Eurasian Economic Union of May 29, 2014 (further – the Agreement).
The total electrical power market of the Eurasian Economic Union (further – the Union) – the system of the relations between subjects of the domestic wholesale electrical power markets of state members of the Union (further – state members) on the basis of in parallel the working electric utility systems connected with purchase and sale of electrical energy (capacity), which is acting on the basis of the acts regulating the total electrical power market of the Union, and the relevant contracts between subjects of the total electrical power market of the Union.
This Concept is aimed at providing forming with state members of the total electrical power market of the Union.
Forming of the total electrical power market of the Union is performed taking into account:
the existing relations of the state members determined by international treaties;
features of functioning and development of the electrical power markets of state members;
priority providing state members with electrical energy of internal consumers;
interactions of state members within parallel work of their electric utility systems;
international experience of forming of the total electrical power markets.
The concepts used in this Concept are understood in the values given in the Agreement and appropriate sections of this Concept.
Forming of the total electrical power market of the Union is performed for the purpose of:
ensuring sustainable development of economies and energy security of state members;
increases in cost efficiency and reliability of functioning of electrical power complexes of state members;
increases in competitiveness of state members and the Union in general in the world market;
forming of common economic space of state members in the field of power industry;
satisfactions of demand of consumers of electrical energy in the total electrical power market of the Union;
ensuring balance of economic interests of participants of the total electrical power market of the Union on the basis of the principle of fair competition.
Tasks of forming of the total electrical power market of the Union are:
development and increase in efficiency of market mechanisms of mutual trade in electrical energy between participants of the total electrical power market of the Union;
creating favorable conditions for development of economies of state members;
increase in level of the competition in trade in electrical energy between participants of the total electrical power market of the Union;
increase in transparency of pricing;
creation of conditions for providing easy access to services of subjects of natural monopolies in the field of power industry within technical capability on condition of priority use of the specified services for ensuring internal requirements of state members when implementing interstate transfer of electrical energy (capacity);
creation of conditions for providing at the corresponding stage of integration of the markets of access for producers and consumers of electrical energy to the markets of electrical energy of state members taking into account interests of national economies;
expansion of opportunities for mutual trade in electrical energy;
decrease in growth rates of the prices of electrical energy for final consumers;
creating favorable conditions for investment into power generation facilities.
Forming of the total electrical power market of the Union is performed based on the following principles specified in Item 5 of the Protocol on ensuring access to services of subjects of natural monopolies in the field of power industry including bases of pricing and tariff policy (appendix No. 21 to the Agreement):
cooperation on the basis of equality, mutual advantage and not drawing economic damage to any of state members;
respect for balance of economic interests of producers and consumers of electrical energy, and also other subjects of the total electrical power market of the Union;
step-by-step harmonization of the legislation of state members in the field of power industry, including regarding disclosure of information by subjects of the total electrical power market of the Union;
priority use of the mechanisms based on the market relation and fair competition for forming of steady system of satisfaction of demand for electrical energy (capacity) in competitive types of activity;
providing easy access to services of subjects of natural monopolies in the field of power industry within technical capability on condition of priority use of the specified services for ensuring internal requirements of state members when implementing interstate transfer of electrical energy (capacity);
step-by-step transformation of structure of national vertically integrated companies in the field of power industry for the purpose of allocation of competitive and exclusive types of activity;
development of the interstate relations in the field of power industry of state members according to the approved model of the total electrical power market of the Union;
step-by-step forming of the total electrical power market of the Union on the basis of in parallel the working electric utility systems of state members taking into account features of the existing models of the electrical power markets of state members;
