About referendum of the Republic of Uzbekistan

I. General provisions

Article 1. Referendum of the Republic of Uzbekistan

Referendum of the Republic of Uzbekistan (further - referendum) national vote of citizens on the most important issues of public and state life for the purpose of adoption of the laws of the Republic of Uzbekistan and other decisions.

The referendum along with elections is direct expression of will of the people. The decisions made by referendum have the highest legal force and can be cancelled or changed only by referendum.

The referendum is held in all territory of the Republic of Uzbekistan.

Article 2. The questions which are not referendum subject

Questions cannot be subject of referendum:

about change of territorial integrity of the Republic of Uzbekistan;

about the Government budget of the Republic of Uzbekistan and taxes;

about amnesty and pardon;

about emergency and urgent measures on ensuring public order, health and safety of the population;

about accomplishment of the obligations following from international treaties of the Republic of Uzbekistan;

connected with appointment and release of officials.

Article 3. The circumstances excluding holding referendum

The referendum is not held in the conditions of the wartime or state of emergency imposed in all territory of the Republic of Uzbekistan and also within three months after the termination of wartime or cancellation of emergency state.

The referendum is not held within year after official publication of results of referendum with same on content or in sense the formulation of question.

Article 4. Legislation on referendum

The legislation on referendum consists of the Constitution of the Republic of Uzbekistan, this Law and other acts of the legislation.

Article 5. Basic principles of holding referendum

The referendum is held on the basis of general, equal and direct declaration of will of citizens in case of secret vote.

Participation of citizens of the Republic of Uzbekistan in referendum is voluntary and free. Nobody has the right to make impact on citizens of the Republic of Uzbekistan with the purpose to force them to participation or nonparticipation in referendum, and also on their free declaration of will.

Citizens of the Republic of Uzbekistan participate in referendum on an equal basis. Each citizen has one voice.

Preparation and holding referendum are performed openly and publicly.

Citizens of the Republic of Uzbekistan participate in referendum directly.

Control of declaration of will of citizens is not allowed.

Article 6. The participation right in referendum

In referendum has the right to participate each citizen of the Republic of Uzbekistan who reached by day or in day of holding referendum of eighteen years.

The citizen of the Republic of Uzbekistan living or being outside the territory of the Republic of Uzbekistan has all completeness of the participation rights in referendum.

Have no right to participate in referendum the citizens recognized by court incapacitated and also persons containing in organizations on execution of the punishment in the form of imprisonment according to the court verdict for the committed heavy and especially serious crimes.

Any straight lines or indirect restrictions of the rights of citizens for participation in referendum depending on origin, social and property status, racial and national identity, floor, education, language, the relation to religion, sort and nature of occupations are forbidden.

Article 7. Publicity in preparation and holding referendum

The state bodies and public associations participating in preparation and holding referendum perform the activities publicly.

Preparation and holding referendum are performed by the commissions on holding referendum which inform citizens on the work, about formation of districts, sites for vote, about structure of the commissions, their location and operating time, acquaint with lists of the voting citizens, report about vote results.

Mass media of the Republic of Uzbekistan light the course of preparation and holding referendum.

Article 8. Openness in preparation and holding referendum

On all actions for preparation and holding referendum have the right to be present observers from political parties, initiative groups of citizens, representatives of mass media, observers from other states and the international organizations. Their powers shall be supported by the relevant documents.
