About approval of Rules of issue of the competence certificate of the specialist in customs declaring

According to Item 1 of article 32 of the Code of the Republic of Kazakhstan of June 30, 2010 "About customs affairs in the Republic of Kazakhstan" I ORDER:

1. Approve Rules of issue of the competence certificate of the specialist in customs declaring.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Ergozhin of E.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction it on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of issue of the competence certificate of the specialist in customs declaring

1. These rules of issue of the competence certificate of the specialist in customs declaring determine procedure for issue of the competence certificate of the specialist in customs declaring.

2. For receipt of the competence certificate of the specialist in customs declaring it is necessary to pass the qualification examination held by the territorial authorities of state revenues determined according to Item 3 of article 32 of the Code of the Republic of Kazakhstan "About customs affairs in the Republic of Kazakhstan" using information systems.

3. The responsible officials of territorial authorities of state revenues holding qualification examination within one working day sum up the results of the held qualification examinations by collection of sheets and creation of the protocol.

4. Based on the signed protocol the head (person, it replacing) and the responsible officials of territorial authority of state revenues holding qualification examination prepares competence certificates, badges of the specialist in customs declaring in the forms approved according to Item 7 of article 32 of the Code of the Republic of Kazakhstan "About customs affairs in the Republic of Kazakhstan".

5. Competence certificates and badges are signed by the head (person, it replacing) territorial authority.

6. Territorial authorities of state revenues make issue of competence certificates of the specialist in customs declaring no later than five working days from the moment of passing qualification examinations.

7. Territorial authorities of state revenues keep the magazine of issue of competence certificates, badges of the specialist in customs declaring in form, according to appendix to Rules.

8. In case of loss (spoil) of the competence certificate of the specialist in customs declaring or badge, and also changes of surname, name, middle name need to be provided to the territorial authority of state revenues which earlier issued the certificate of the specialist in customs declaring, the statement in any form with appendix:

copies of the identity document;

two color photos 3,5 x 4,5 size of centimeter.

9. Effective period of the competence certificate of the specialist in customs declaring constitutes two years.

After the termination of effective period the competence certificate of the specialist in customs declaring is considered invalid.

10. In case of cancellation of the competence certificate in connection with the termination of effective period, the customs declaring specialist in two months prior to the termination of effective period submits the application for passing an examination on recertification according to item 4 of article 32 of the Code of the Republic of Kazakhstan of June 30, 2010 "About customs affairs in the Republic of Kazakhstan" with appendix of the existing competence certificate. In case of successful passing an examination the existing competence certificate becomes invalid from the moment of registration new.

11. If the competence certificate of the specialist in customs declaring is issued on the basis of the incomplete or false information shown by the applicant, the competence certificate is subject to cancellation.

12. The decision on cancellation of the competence certificate is drawn up by the order of the head (person, it replacing) territorial authority of state revenues. At the same time the repeated application for issue of the competence certificate is considered by territorial authority of state revenues upon termination of one year from the date of adoption of the order on cancellation.
