About approval of Rules of maintaining and contents of the state inventory of sources of emissions and absorption of greenhouse gases

According to Item 3 of article 158-2 of the Ecological code of the Republic of Kazakhstan of January 9, 2007, I ORDER:

1. Approve the enclosed Rules of maintaining and contents of the state inventory of sources of emissions and absorption of greenhouse gases.

2. To provide to department on climate change of the Department of Energy of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining and contents of the state inventory of sources of emissions and absorption of greenhouse gases

Chapter 1. General provisions

1. Rules of maintaining and contents of the state inventory of sources of emissions and absorption of greenhouse gases (further - Rules) are developed according to Item 3 of article 158-2 of the Ecological code of the Republic of Kazakhstan of January 9, 2007 (further – the Code) and determine procedure for maintaining and contents of the state inventory of sources of emissions and absorption of greenhouse gases (further – the State inventory).

2. In these rules the following concepts are used:

1) emissions of greenhouse gases – release of greenhouse gases in the atmosphere on certain site and during the certain period of time;

2) absorption of greenhouse gases – process, the mechanism or natural complex

3. The authorized body in the field of environmental protection (further – authorized body) will organize development and maintaining the State inventory.

Chapter 2. Maintaining and contents of the state inventory

4. The state inventory contains data on sources of emissions of greenhouse gases, operators of installation, on the number of emissions and absorption of greenhouse gases.

5. Maintaining the State inventory includes realization of the following events:

1) receipt of the reporting under emissions of greenhouse gases of operators of installations in paper or electronic type;

2) processing of the obtained data, and entering of data into the State inventory;

3) analysis and forecasting of emissions and absorption of greenhouse gases.

6. Maintaining the State inventory is performed within the year following after accounting year.

7. When maintaining the State inventory the reports of operators of installations on inventory count of greenhouse gases developed in the forms approved by the order of the acting minister of power industry of the Republic of Kazakhstan of July 28, 2015 No. 502 "About approval of report forms about inventory count of greenhouse gases" are used (registered in the Register of state registration of regulatory legal acts for No. 11818) (further – the Order No. 502).

The operator of installation till April 1 of the year following the accounting period sends the inventory report of greenhouse gases in paper form to authorized body or to its territorial subdivisions.

At the same time verifications the inventory reports of emissions of greenhouse gases provided by subjects of administration are not subject.

The data specified in the inventory reports of greenhouse gases submitted by the operator of installation in paper form are introduced in the State inventory by the operator of the State inventory.

8. By provision of electronic report form, the operator of installation is registered in the State inventory and fills the report form approved by the Order No. 502.

9. The operator of installation falling under requirements of article 94-2 of the Code after filling of report form sends it for verification to accredited body on validation and verification.

The accredited body on validation and verification carries out verification of data of operators of installations in their reports for accounting year in the State inventory. In case of need entering of adjustments into the report, accredited body on validation and verification sends it to completion to the operator of installation.

The operator of installation till April 1 of the year following the accounting period sends the inventory report of greenhouse gases in electronic form to the State inventory.

10. The subject of administration after filling of electronic report form sends it without verification to territorial subdivisions of authorized body in the State inventory till April 1 of the year following the accounting period.

11. The authorized body considers the report regarding compliance the Order No. 502, availability of verification of the report by accredited body on validation and verification and registers it within 30 calendar days from the date of its giving.

In case of discrepancy the Order No. 502 and lack of verification sends the report to completion.

Territorial subdivisions of authorized body consider the report regarding compliance the Order No. 502 and register it within 30 calendar days from the date of its giving.

In case of discrepancy of the report the Order No. 502 send it to completion.
