About approval of Rules of passing of certification of personnel of the operating organization

In compliance item 4 of article 18 of the Law of the Republic of Kazakhstan of April 14, 1997 "About use of atomic energy", PRIKAZYVAYU:

1. Approve the enclosed Rules of passing of certification of personnel of the operating organization.

2. To provide to committee of atomic and energy control and supervision of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of passing of certification of personnel of the operating organization

1. General provisions

1. These rules of passing of certification of personnel of the operating organization (further - Rules) are developed according to the Law of the Republic of Kazakhstan of April 14, 1997 "About use of atomic energy" and determine procedure for passing of certification by personnel of the operating organizations (further - certification) performing activities in the field of use of atomic energy.

2. Procedure for passing of certification in authorized body

2. Certification in authorized body in the field of use of atomic energy (further - authorized body) there undergo the following categories of personnel of the operating organization:

1) personnel of nuclear installation which job responsibilities provide direct control of installation, safety when implementing the types of activity connected with use of atomic energy;

2) personnel of nuclear installation which job responsibilities are connected taking into account and control of nuclear materials, sources of ionizing radiation, radioactive waste, with physical protection of nuclear installation and nuclear materials;

3) personnel of radiation, electrophysical installation to which job responsibilities control of radiation safety, accounting and control of sources of ionizing radiation belongs.

3. Certification in authorized body is subdivided on:

1) primary certification;

2) periodic certification;

3) extraordinary certification.

4. Primary certification is carried out no later than two months after position assignment in time on category which belongs certifications according to Item 3 of these rules.

5. Periodic certification is carried out once in three years according to the schedule of carrying out periodic certification.

6. Extraordinary certification is appointed in the following cases:

1) assumption of labor accidents;

2) the revealed gross violations of requirements of radiation and nuclear safety during scheduled and unscheduled inspections by authorized body in the operating organization;

3) according to the decision of the operating organization.

7. Extraordinary certification does not cancel terms of periodic certification.

8. For certification passing the operating organization submits to authorized body the request with appendix of the following documents:

1) representation from the operating organization for form, according to appendix to these rules;

2) the documents confirming education, qualification and work experience of the worker who is subject to certification;

3) the job description of the worker who is subject to certification;

4) the copy of the order on position assignment (in case of passing of primary certification).

9. The authorized body within two working days from the moment of receipt of the request with the enclosed documents reports to the operating organization about acceptance or about request variation. In case of variation of the request reasons for rejection are specified. The operating organization submits the application after elimination of noted shortcomings again.

10. In case of adoption of the request the authorized body within two working days makes the decision on date and the venue of certification what informs the operating organization on.

11. For carrying out certification the order of the first head of authorized body creates the Commission from among the deputy manager of the department performing management in the field of use of atomic energy and heads of managements of this department which number of members is odd and constitutes at least five people.

Commission session is competent with the quorum making at least two thirds of structure of the commission.

The secretary is not member of the commission and has no right to vote.

12. Certification is carried out within thirty calendar days after decision making about its carrying out.

13. Certification in authorized body includes:

1) testing;

2) interview (for the personnel responsible for control of radiation safety);

3) issue of the protocol certifying results of passing of certification.

14. Testing is held by the automated computer method in the state or Russian languages at the choice of the certified worker.

15. The list of test questions is developed and affirms authorized body and includes the questions connected with knowledge of the legislation in the field of use of atomic energy.
