1. Approve the enclosed Rules of creation and the address of parts of assigned amount, emission reduction units, units of certified emission reduction, units of absorption of the greenhouse gases and other derivatives provided by international treaties of the Republic of Kazakhstan.

2. To provide to department on climate change of the Department of Energy of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of the data on execution provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of creation and the address of parts of assigned amount, emission reduction units, units of certified emission reduction, units of absorption of the greenhouse gases and other derivatives provided by international treaties of the Republic of Kazakhstan

1. General provisions

1. These rules of creation and the address of parts of assigned amount, emission reduction units, units of certified emission reduction, units of absorption of the greenhouse gases and other derivatives provided by international treaties of the Republic of Kazakhstan (further - Rules) are developed according to the subitem 30) of article 17 of the Ecological code of the Republic of Kazakhstan of January 9, 2007 (further - the Code) and determine procedure for creation and the address of parts of assigned amount, emission reduction units, units of certified emission reduction, units of absorption of the greenhouse gases and other derivatives provided by international treaties of the Republic of Kazakhstan (further - carbon units).

2. In these rules the following terms and determinations are used:

1) the address - any transaction with carbon units connected with their transfer from one account on another between different registers of carbon units or in one register of carbon units;

2) the supervising committee on joint implementation the international body performing observation of projects implementation of joint implementation;

3) the test period - the period of action of quantitative emission reduction commitments of the greenhouse gases established by the international treaty ratified by the Republic of Kazakhstan;

4) reserve of assigned amount of the test period - the minimum amount of assigned amount units which remains in the state register of carbon units according to requirements of the international treaty ratified by the Republic of Kazakhstan;

5) the operator of the state register of carbon units (further - the operator) - the organization performing maintaining the state register of carbon units;

6) the international register of transactions - the international system of registration of the made transactions with carbon units in national registers of carbon units managed by the secretariat of the Framework convention of the United Nations on climate change and performed for the purpose of check of authenticity of transactions;

7) unit of absorption of greenhouse gases - the carbon unit applied to calculation of absorption of greenhouse gases;

8) the register of the clean development mechanism - the register created by Executive body of the clean development mechanism of the Kyoto protocol to the Framework convention of the United Nations on climate change for carrying out the transactions with certified emission reductions made by projects on the clean development mechanism;

9) the operator of the register of the clean development mechanism - the international organization performing maintaining the register of the clean development mechanism within the international treaty on climate change;

10) derivative carbon units - the short-term and long-term units of certified emission reduction issued according to projects on increase in absorption of greenhouse gases as a result of activities for reforestation and afforestation;

11) emission reduction unit - the carbon unit received as a result of project implementation, the joint implementation performed within the mechanism;

12) unit of certified emission reduction - the carbon unit received as a result of project implementation, performed within the clean development mechanism.

3. With carbon units the following transaction types on creation and the address are made:

1) creation and issuance;

2) converting of one type in another;

3) transfer from one register of carbon units to another;

4) transfer from one person to another within one register of carbon units;

5) retirement;

6) change of effective period;

7) cancellation;

8) transfer for the next test period.

4. Creation and the address of carbon units in the territory of the Republic of Kazakhstan is performed on the basis of carrying out transactions in the state register of carbon units of the Republic of Kazakhstan which is created and kept by the operator, being the subordinated organization for regulation of emissions of greenhouse gases of authorized body in the field of environmental protection (further - authorized body) according to Rules of maintaining the state register of the carbon units approved by the order of the Minister of environmental protection of the Republic of Kazakhstan of May 10, 2012 No. of the 147th (it is registered in the Register of state registration of regulatory legal acts No. 7702).
