About approval of Rules of approval and withdrawal of the passport of production, form of the passport of production

1. Approve:

1) Rules of approval and withdrawal of the passport of production according to appendix 1 to this order;

2) form of the passport of production according to appendix 2 to this order.

2. To provide to development department of the oil industry of the Department of Energy of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of the copy of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. Recognize invalid:

1) the order of the Oil Minister and gas of the Republic of Kazakhstan of August 27, 2012 No. 156 "About approval of the form of the passport of production including data for its approval" (No. registered in the Register of state registration of regulatory legal acts 7186);

2) the order of the Oil Minister and gas of the Republic of Kazakhstan of September 25, 2013 No. 174 "About modification of the order of the Oil Minister and gas of the Republic of Kazakhstan of August 27, 2011 No. 156 "About approval of the form of the passport of production including data for its approval" (No. registered in the Register of state registration of regulatory legal acts 8839).

4. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after the first official publication.

Rules of approval and withdrawal of the passport of production

Chapter 1. General provisions

1. These rules of approval and withdrawal of the passport of production (further – Rules) are developed according to the subitem 2) of article 7 of the Law of the Republic of Kazakhstan "About state regulation of production and turnover of separate types of oil products" (further – the Law) and determine approval procedure and withdrawal of the passport of production.

2. In these rules the following basic concepts are used:

1) authorized body in the field of production of oil products – the central executive body performing management in the field of state regulation of production of oil products (further – authorized body);

2) producer of oil products – the legal entity having oil refinery on the property right and (or) other legal causes and performing production of oil products according to the passport of production, and also realization of the made own oil products and (or) transfer of the oil products which are raw materials supplied by the customer conversion product;

3) the passport of production – the document of the established form reflecting indicators of production capacities of the producer of oil products, its main characteristics, regulating use of the available equipment for observance of engineering procedure of production.

Chapter 2. Approval procedure and withdrawal of the passport of production

3. The passport of production is developed by producer of oil products and affirms authorized body according to subitem 2-1) of article 7 of the Law.

The passport of production affirms for the period equal to 3 (three) calendar years from the moment of its approval by authorized body.

4. The statement for approval of the passport of production (further – the Application) is submitted by producer of oil products to authorized body in any form taking into account Items 7 and 8 of these rules.

5. The application is submitted purposely to office of authorized body or by mail by the registered mail with the notification.

6. Date of receipt by authorized body of the Statement date of its acceptance of authorized body by office is.

7. The name, business and identification number, legal address of the producer of oil products, the address of oil refinery are specified in the Statement.

8. The passport of production developed in form, according to appendix 2 to this order in 3 (three) copies, the numbered and strung together type, signed by the head of the producer of oil products, and also technical and operational documentation is enclosed to the Application (the acceptance act of object in operation, production schedules, the liquidation plan of emergencies, the declaration of industrial safety).

9. Within 15 (fifteen) working days the authorized body considers the Application from the date of its acceptance of authorized body by office and following the results of sends to producer of oil products:

1) the approved passport of production;

2) notes to the passport of production in case of its discrepancy to the form approved according to appendix 2 to this order.

In the case provided by the subitem 1) of this Item of Rules, the authorized body sends to producer of oil products the approved passport of production in 2 (two) copies, 1 (one) copy is stored in authorized body.

In the case provided by the subitem 2) of this Item of Rules producer of oil products the current of 10 (ten) working days from the date of receipt of notes corrects notes to the passport of production and represents for approval to authorized body according to the procedure, established by these rules. At the same time, the authorized body considers repeatedly arrived Application within 10 (ten) working days.
