Rules of determination of the amount of payment under the agreement on establishment of the servitude concerning the parcels of land which are in federal property

1. These rules establish procedure for determination of the amount of payment under the agreement on establishment of the servitude concerning the parcels of land which are in federal property (further - the parcels of land).

2. The amount of payment is determined by the agreement on establishment of the servitude based on the cadastral cost of the parcel of land and is calculated as 0,01 of percent of cadastral cost of the parcel of land for every year of effective period of the servitude if other is not established by these rules.

3. The amount of payment is determined by the agreement on establishment of the servitude signed concerning the parcels of land which are in federal property and provided in permanent (termless) use, or in the life inherited tenancy, either in lease, or in free use as difference of market value of the specified rights to the parcel of land before establishment of the servitude which is determined by the independent appraiser in accordance with the legislation of the Russian Federation about estimative activities, except as specified establishments of the servitude concerning the parcel of land provided to public authority, local government body, state or to municipal unitary enterprise, the state company or the public or local government office provided that agreement party about establishment of the servitude is one of specified persons.

4. Change of the owner of the parcel of land is not the basis for review of the amount of payment under the agreement on establishment of the servitude determined according to these rules.

5. If the servitude is established concerning part of the parcel of land, the amount of payment is determined by the agreement on establishment of the servitude in proportion to the area of this part of the parcel of land according to these rules.
