1. Approve the enclosed Rules of investigation of accidents, disasters, the catastrophic crashes which led to emergence of emergency situations.

2. (Petrov V. V.) in the procedure established by the legislation to provide to committee on emergency situations of the Ministry of Internal Affairs of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order, its direction on official publication in periodic printing editions and in information system of law of "Adilet";

3) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan.

3. To impose control of execution of this order on the deputy minister of internal affairs of the Republic of Kazakhstan Bozhko V. K.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of investigation of accidents, disasters, the catastrophic crashes which led to emergence of emergency situations

1. General provisions

1. These rules of investigation of accidents, disasters, the catastrophic crashes which led to emergence of emergency situations (further - Rules) are developed according to subitem 70-14) of Item 1 of article 12 of the Law of the Republic of Kazakhstan of April 11, 2014 "About civil protection" and determine procedure for investigation of accidents, disasters, the catastrophic crashes which led to emergence of emergency situations.

The purpose of investigation of the reasons of accidents of disasters, the catastrophic crashes which led to emergence of emergency situations are identification of the reasons, taking measures to elimination of their effects, holding necessary actions for their prevention and scoping of material damage.

2. Investigation of accidents, disasters, the catastrophic crashes which led to emergence of emergency situations

4. The body which created the commission depending on the scale of emergency situation, determines terms of conducting investigation of accidents, disasters, the catastrophic crashes which led to emergence of emergency situations.

5. The commission chairman as required appoints technical, economic and other examinations on the questions concerning investigation of accidents, disasters, catastrophic crashes which led to emergence of emergency situations.

During the investigation the commission receives written and oral explanations from eyewitnesses of event, official and other persons, finds out the circumstances preceding accident, disaster, catastrophic crash, establishes its reasons, nature of violations of service conditions of technical devices, engineering procedures, violations of requirements of fire and industrial safety, determines actions for mitigation of consequences and prevention of similar accidents, disasters, catastrophic crashes which led to emergence of emergency situations and the caused material damage.

6. The commission within ten working days from the date of the end of investigation draws up the statement of investigation of the reasons of accidents, disasters, the catastrophic crashes which led to emergence of emergency situations in form according to appendix to these rules.

7. The commission on results of investigation of emergency situation draws up materials of investigation and informs the relevant state bodies and the organizations within five working days.

8. Materials of investigation include:

1) the legal act about appointment of the commission;

2) act of investigation;

3) protocol of survey of the place of emergence of emergency situation, plans, schemes, sketches, pictures;

4) decision of the commission chairman on purpose of technical, economic and other expertize;

5) conclusion of commission of experts about causes of accident, results of laboratory and other researches, experiments, analyses;

6) reports of division managers of forces of civil protection if these divisions were caused for liquidation of emergency situation;

7) protocols of poll and explanation of the witnesses, persons involved in accident, and also the officials responsible for observance of the established security measures;

8) data on damage, and also other materials (references, statements) characterizing circumstances and the reasons of emergency situation.

9. In case of identification of illegal actions or bezdeystviye of officials and citizens, materials of investigation are reported by the commission to relevant organs for involvement of perpetrators to responsibility according to the current legislation.

10. The interested state bodies and their territorial subdivisions, and also local executive bodies and the organizations provide studying and the analysis of circumstances, reasons of emergency situation, take measures for realization of the actions for its prevention offered by the commission.

11. Investigation of accidents on hazardous production facilities is made by authorized body in the field of industrial safety according to Chapter 15 of the Law of the Republic of Kazakhstan "About civil protection".
