2) placement of this order on official Internet resource of the Ministry of Justice of the Republic of Kazakhstan.

3. To impose control of execution of this order on the Deputy minister of justice Azimova E. A.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of assignment of rank "Honored Inventor of the Republic of Kazakhstan"

Chapter 1. General provisions

1. These rules of assignment of rank "Honored Inventor of the Republic of Kazakhstan" (further - Rules) are developed according to Item 5 of article 9 of the Law of the Republic of Kazakhstan of July 16, 1999 "The patent law of the Republic of Kazakhstan" (further - the Patent Law) and regulate procedure for assignment of rank "Honored Inventor of the Republic of Kazakhstan".

2. Assignment of rank "Honored Inventor of the Republic of Kazakhstan" (further - rank) is one of important moral incentives, expression of public recognition of fruitful activities of citizens, their capabilities and talent, and is intended to increase innovative activity of citizens, to encourage their efforts in economic and social development of the Republic of Kazakhstan.

Chapter 2. Procedure for assignment of rank "Honored Inventor of the Republic of Kazakhstan"

The order of the expert organization provided in article 4-1 of the Patent Law (further - the expert organization), forms the contest committee on consideration of petitions for assignment of rank (further - the commission) which part representatives of the Ministry of Justice of the Republic of Kazakhstan are (further - authorized body), the organizations managing property rights on collective basis, public associations in the sphere of patenting, members of Public council concerning activities of judicial authorities, the staff of the expert organization.

4. The rank is given by results of the competition held by the expert organization annually in the second quarter among citizens of the Republic of Kazakhstan who are authors of the most important and widely worked inventions.

5. Working body of the Commission is the expert organization.

The commission consists of the chairman, the vice-chairman, members and the secretary of the commission. The commission chairman presides over meetings, performs the common directorship and control of the made decisions. According to the decision of the commission chairman during its absence functions are performed by the deputy.

The secretary of the commission is the employee of the expert organization.

6. Commission sessions are considered competent if at them there is more than a half from total number of members of the commission.

By results of studying by members of the commission of competitive materials, each present member of the commission fills in on each candidate the estimative sheet for determination of the winner in form according to appendix to these rules.

The decision of the Commission is made based on estimative sheets and drawn up by the protocol.

7. The petition for assignment of rank (further - the petition) is initiated:

1) authorized body;

2) state bodies;

3) scientific organizations or public associations;

4) companies, organizations or organizations.

8. Petitions in any form are represented to the expert organization annually till May first.

9. The petition is signed by the first head of state body, scientific organization or public association (or person fulfilling its duties) in the place of the main (permanent) work, and also the first director, organizations or the organizations, implemented in production the invention (inventions) of the represented candidate in which surname, the name, middle name (are entered in case of its availability) the candidate, the basis of its promotion to assignment of rank with indication of the main direction of inventive activities, value for industry, total quantity of the taken-out patents, copyright certificates, availability of withdrawals of the companies, organizations and organizations about implementation of the invention, practical use, results of inventive activities for the last three years until promotion, awards and encouragement for the inventive activities, other activities reflecting merits and achievements of the candidate.

1) copy of the identity document of the candidate;

2) responses, reviews and other materials about the most important and widely worked inventions.

10. The arrived petitions annually till May tenth are sent for consideration of the commission for adoption of the decision according to them.

11. The commission by consideration of petitions takes the following criteria of the importance of contribution of the candidate for inventive activities into account:

1) availability of patents for inventions;

2) results of implementation and application of patented inventions in various industries of economy (withdrawals of the companies (organizations, the organizations), person performing scientific or scientific and technical activities, adoption deeds of the invention);

3) total quantity of the taken-out patents (preliminary and innovative patents), from them acting.

12. The provided petitions are considered within ten working days from the moment of their receipt in the commission.

The commission makes the decision on person (persons) which gathered the greatest number of points on assignment of rank (ranks).

13. The management of the expert organization within ten calendar days from the moment of pronouncement of the decision by the commission issues the order on assignment of rank (ranks).
