1. Approve the enclosed Regulations on procedure for examination by authorized officers of bodies of fishing control of things, vehicles, tools of production of fish, fishery products in fishing grounds or in the territory adjoining to them at distance to one kilometer from the coastline.

Regulations on procedure for examination by authorized officers of bodies of fishing control of things, vehicles, tools of production of fish, fishery products in fishing grounds or in the territory adjoining to them at distance to one kilometer from the coastline

1. This Provision developed based on Item 114 of Rules of maintaining fishing economy and fishery approved by the Presidential decree of the Republic of Belarus of December 8, 2005 No. 580 "About some measures for increase in efficiency of fishing activities, enhancement of public administration by it" (The national register of legal acts of the Republic of Belarus, 2005, No. 196, 1/6996; The national legal Internet portal of the Republic of Belarus, 25.12.2013, 1/14679), is determined procedure for carrying out examination of things, tools of production of fish, products of fishery, vehicles (further if other is not established, - examination) in fishing grounds or in the territory adjoining to them at distance to one kilometer from the coastline (further - fishing grounds) by the authorized officers of bodies of fishing control exercising control of fishery and fishing activities except fish breeding, according to the legislation on control (supervising) activities (further - authorized officers of bodies of fishing control).

2. In this Provision terms and their determinations in the values established by Rules of maintaining fishing economy and fishery (further - Rules), and also the following terms and their determinations are used:

examination of things, tools of production of fish, fishery products - action for ensuring control of fishery and fishing activities, except fish breeding, in fishing grounds, consisting in check by authorized officers of bodies of fishing control of the things, tools of production of fish, products of fishery which are under physical person, by visual and their manual contact inspection for the purpose of detection illegally the got products of fishery and tools of production of fish, including the prohibited tools of production of fish used at the same time;

examination of the vehicle - action for ensuring control of fishery and fishing activities, except fish breeding, in fishing grounds, consisting in presentation of the vehicle and any things which are in it for their visual and manual contact inspection by authorized officers of bodies of fishing control for the purpose of detection illegally of the got products of fishery and tools of production of fish, including the prohibited tools of production of fish used at the same time;

the witness - the capable full age person who is not interested in the result of examination participating in carrying out examination for the certificate of its fact, the course and results in the cases established by this Provision.

3. Examination is carried out in fishing grounds.

Examination is carried out concerning things, tools of production of fish, products of fishery, vehicles of physical persons (except as specified, specified in Item 7 of this provision) in case of establishment of the sufficient data specifying availability at them the prohibited tools of production of fish or products of fishery.

4. Examination of things, tools of production of fish, products of fishery is carried out in the presence of the physical person transferring (transporting) these things, tools of production of fish, fishery products (further - the owner of things).
