About approval of "Regulations on lungs and ultralight aircrafts of the Kyrgyz Republic"

According to the Air code of the Kyrgyz Republic and, being guided by the order of the Government of the Kyrgyz Republic of September 15, 2014 No. 530 "About delegation of separate rule-making powers of the Government of the Kyrgyz Republic to number of state bodies of the executive authority", and also for the purpose of stimulation of development of the activities performed by lungs and ultralight aircrafts in the Kyrgyz Republic I order:

1. Approve the enclosed Regulations on lungs and ultralight aircrafts of the Kyrgyz Republic.

2. To the agency of civil aviation under the Ministry of Transport and Communications of the Kyrgyz Republic to accept this order to execution.

3. To impose control of execution of this order on the Deputy minister of transport and communications of the Kyrgyz Republic Mamyrkanov E. T.

Regulations on lungs and ultralight aircrafts of the Kyrgyz Republic

I. General provisions

This provision regulates use of lungs and ultralight aircrafts in airspace of the Kyrgyz Republic.

Activities of use of lungs and ultralight aircrafts in the territory and in airspace of the Kyrgyz Republic are regulated by the Air code of the Kyrgyz Republic, aviation rules of the Kyrgyz Republic, this provision operating with the regulating documents in the field developed according to the legislation of the Kyrgyz Republic, and also according to international treaties.

Regulations of this provision are obligatory for all persons using lungs and ultralight aircrafts in the Kyrgyz Republic and shall be performed along with all other Aviation Rules of the Kyrgyz Republic.

This Provision is not applied to the spheres pilots used in the meteorological purposes and also pilotless uncontrollable aerostats.

II. The basic concepts and terms used in this provision

The appraisal report of technical condition of the air vehicle - the document constituted by the applicant with involvement of specialists (the owner or the operator) for determination of the flight validity of lungs and ultralight aircrafts (appendix No. 1).

The light aircraft (further - LAN) - the air vehicle which maximum takeoff weight constitutes less than 5700 kilograms, including the helicopter which maximum takeoff weight constitutes less than 3100 kilograms.

The ultralight aircraft (further - SVS) - the air vehicle which maximum takeoff weight constitutes no more than 750 kilograms, without the weight of aviation means and means of rescue.

The main change - change in standard pattern of lungs and ultralight aircrafts and the operating documentation which significantly influences its flight validity and requires its new certification.

The hang glider - the air vehicle is heavier than air with elastic surface on tough framework, the balanced management system, not set in motion by the power unit which lifting force is created generally due to aerodynamic reactions on elastic surface, mobile in flight.

Evidential documentation of easy and extralight air vehicles - documentation containing results of certification of easy and extralight air vehicles and its constituents (technical reports, the conclusions; acts, test reports), drawn up and approved according to these rules.

Modification of easy and extralight air vehicles - change of the accepted standard pattern of sample of aviation engineering which influences the flight validity of specific sample of aviation engineering and requires certification of sample in necessary amount.

The power glider - the air vehicle is heavier than air with elastic surface on tough framework, the balanced management system, set in motion by the power unit which lifting force is created generally due to aerodynamic reactions on elastic surface, mobile in flight.

The powered glider - the glider having in the design the cleaning-up, or not cleaning up engine and the screw which are the auxiliary power station providing take off and landing of glider.

Airworthiness standards - the document containing, established, accepted or recognized as the Kyrgyz Republic, the requirements to lungs and ultralight aircrafts, their engines, air screws aimed at safety-of-life function.

The specifications and technical documentation - in relation to this Provision includes the following documents:

- specification on development of type of easy and extralight air vehicles or their constituent;

- airworthiness standards;

- technical specifications according to which production of the easy and extralight air equipment is performed;

- test programs of samples of easy and extralight air vehicles and methods of determination of compliance to their requirements of airworthiness standards;

- design, technological, fabrication, operating and repair documentation.

The paraplane - the air vehicle is heavier than air with elastic surface without tough framework which aerodynamic form and lifting force is created at the expense of blowing of elastic surface by counter air.

The runup area and landings of easy and extralight air vehicles is the any site of the water or land surface, or structure surface chosen by the operator under its responsibility for taking-off and landing of easy and extralight air vehicles according to its flight technical characteristics.

Developer of easy and extralight air vehicles - person, the performing creation of easy and extralight air vehicles and the bearing responsibility for quality of testing of easy and extralight air vehicles, ensuring their compliance to requirements of airworthiness standards, up to the end of operation.

Self-made lungs and ultralight aircrafts - the air vehicles of nonindustrial construction which are subdivided into the following categories:

- category 1 - the air vehicles constructed according to ready author's documentation, having already tested earlier air vehicles of extralight aircraft which received positive assessment in use as prototype;

- category 2 - the air vehicles of traditional design and aerodynamic configuration of new development which do not have certain prototype;

- category 3 - the air vehicles constructed according to again developed documentation, offered for small-scale release;

- category 4 - the air vehicles which do not have prototype according to aerodynamic or constructive schemes.

The certificate of type of easy and extralight air vehicles - the document certifying compliance of type of easy and extralight air vehicles to existing rules of the flight validity (appendix No. 4).

The certificate (certificate) of the flight validity of easy and extralight air vehicles - the document certifying compliance of copy of easy and extralight air vehicles to existing rules of the flight validity, granting the right to their flight operation with established for data of easy and extralight air vehicles (appendix No. 2).

The certificate of the validity of components - the document certifying compliance of the engine, equipment or other constituent of easy and extralight air vehicles to requirements of airworthiness standards.

Certification of lung and the ultralight aircraft - the procedure of establishment of compliance of type of easy and extralight air vehicles, their engine and oborudovaniye to existing rules of the flight validity.

The owner of easy and extralight air vehicles - person (persons) owning lung and/or the ultralight aircraft on the property rights.

Constituents of easy and extralight air vehicles - the engine(s), air screws and the aircraft equipment.

The table of correspondences of easy and extralight air vehicles - the document, witnessing, about compliance of type of easy and extralight air vehicles, the engine, air screw and the equipment to requirements of airworthiness standards.

Standard pattern of easy and extralight air vehicles - the design of sample of easy and extralight air vehicles establishing compliance to requirements of airworthiness standards by results of preliminary, acceptance, operational and, in necessary cases, monitoring tests.

The operator of easy and extralight air vehicles - the person (persons) who is engaged in operation of easy and extralight air vehicles and/or offering the services in this area.

The operating documentation of easy and extralight air vehicles - documentation regulating flight and technical operation, including maintenance of lung and the ultralight aircraft, its engine, equipment and containing compulsory operational procedures, restrictions and recommendations. The operating documentation includes:

- flight manual;

- maintenance guide;

- maintenance schedule.

The export airworthiness certificate of easy and extralight air vehicles - the document on the validity of easy and extralight air vehicles to flights certifying compliance of copy of easy and extralight air vehicles to requirements of airworthiness standards and issued on one-time technical flight of easy and extralight air vehicles from one state in another.
