About approval of Rules on ensuring industrial safety in case of operation of hydraulic engineering constructions and devices on hazardous production facilities

Based on subitem 7.4 of Item 7 of the Regulations on the Ministry of Emergency Situations of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 29, 2006 No. 756 "About some questions of the Ministry of Emergency Situations" the Ministry of Emergency Situations of the Republic of Belarus DECIDES:

1. Approve the enclosed Rules on ensuring industrial safety in case of operation of hydraulic engineering constructions and devices on hazardous production facilities.

2. This resolution becomes effective since May 21, 2015.

Rules on ensuring industrial safety in case of operation of hydraulic engineering constructions and devices on hazardous production facilities

Section I. General provisions

Chapter 1. Scope and distribution

1. These rules establish requirements for ensuring industrial safety in case of operation of hydraulic engineering constructions and devices on hazardous production facilities - shlamokhranilishcha of silvinitovy enrichment factories and stores of liquid waste of enrichment installations of nonmetallic minerals.

Requirements of these rules are obligatory for all organizations irrespective of the legal forms and patterns of ownership designing, building, reconstructing, operating and conducting research works on hydraulic engineering constructions and devices on hazardous production facilities shlamokhranilishch silvinitovy enrichment factories and stores of liquid waste of enrichment installations of nonmetallic minerals.

2. These rules extend to stores of liquid waste of the subjects of industrial safety conducting conversion and enrichment of potash salts and nonmetallic minerals.

These rules do not extend to constructions of sewage treatment, transportation systems and stacking of the dehydrated tails.

3. For the purposes of these rules the following terms and determinations are applied:

the hydraulic engineering construction and the device on hazardous production facility (further - GTS) - the engineering construction with the corresponding equipment intended for accumulating and clarification of liquid waste of silvinitovy enrichment factories or installations of nonmetallic minerals;

the store - storage of liquid waste of GTS shlamokhranilishch silvinitovy enrichment factories or liquid waste of enrichment installations of nonmetallic minerals (shlamokhranilishche, pond settler, the store of industrial drains) in which there is clarification of liquid phase of pulp. Reservoir of stores is created by preliminary ridging of the site of the territory by the dams built from soil by bulk method to complete height or separate queues with considerable height of dam;

pond settler - the artificial reservoir with complex of constructions in the form of bulk dams from local clay soil formed by barrier of the earth territory intended for permanent or temporary accumulation of production sewage or brines of their upholding, evaporation, after-treatment for the purpose of further use in water recirculation (rassolooborot) or before release in reservoirs;

rassolosbrosny and rassolozaborny constructions - the constructions arranged in stores for providing necessary omissions of the clarified liquid (brines and technical water);

silvinitovy enrichment factory (further - SOF) - the subject of industrial safety or its structural division, the interconnected production system of technology complex intended for conversion of hydrochloric ores, receipt of ready-made product and warehousing of production wastes;

system of superficial drain - complex of the constructions which are used for the purpose of interception and withdrawal of the superficial drain accumulating before riding dam in the lower byef bypassing the store. Mountain ditches, coastal channels, pipes, tunnels concern to them. Need of the organization of superficial drain is provided in the project;

the specialized project organization - the organization developing the project documentation with the set conditions of safe operation of hydraulic engineering constructions and devices;

suffosion - carrying out of particles of soil with filtrational water;

tails - the solid galitovy waste of process of enrichment consisting generally of rock-forming minerals and containing insignificant quantity of useful components which additional recovery is economically inexpedient;

shlamokhranilishche - the hydraulic engineering construction intended for hydraulic stacking of clay and salt slimes or waste of enrichment installations of nonmetallic minerals of their sedimentation, department of brines or the water intended for turnover use;

slimes - waste of enrichment factories which in the form of pulp go to the store.

Chapter 2. General requirements

4. In case of operation of GTS requirements of the these rules, Cross-industry general rules for labor protection approved by the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of June 3, 2003 No. 70 (The national register of legal acts of the Republic of Belarus, 2003, No. 87, 8/9818), other regulatory legal acts (further - the NPA), requirements of the technical regulatory legal acts, obligatory for observance (further - TNPA) considering features of objects of GTS, their specifics, and also requirements in the field of environmental protection shall be observed.

5. The stores which are technology connected with process of production and conversion of minerals shall be built and be operated on the projects developed and approved in accordance with the established procedure.

6. The technical devices and potentially dangerous objects applied on GTS shall conform to requirements of the technical regulation of the Customs union "About safety of machines and the equipment", the Customs union accepted by the decision of the Commission of October 18, 2011 No. 823.

7. The subject of industrial safety operating GTS shlamokhranilishch SOF shall have the declaration of industrial safety developed and which is drawn up according to the Regulations on procedure for development, registration and submission of the declaration of industrial safety, introduction in it of changes and (or) amendments and accounting of such declarations approved by the resolution of Council of Ministers of the Republic of Belarus of August 10, 2016 No. 627 (The national legal Internet portal of the Republic of Belarus, 18.08. 2016, 5/42475).

8. The subject of industrial safety operating GTS shlamokhranilishch SOF shall develop Regulations on procedure for the organization and implementation of production supervision in the field of industrial safety based on Approximate regulations on the organization and implementation of the production supervision in the field of industrial safety approved by the resolution of the Ministry of Emergency Situations of the Republic of Belarus of July 15, 2016 No. 37.

9. In case of accidents on production investigation shall be made according to the Rules of investigation and accounting of labor accidents and occupational diseases approved by the resolution of Council of Ministers of the Republic of Belarus of January 15, 2004 No. 30 (The national register of legal acts of the Republic of Belarus, 2004, No. 8, 5/13691), the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus and the Ministry of Health of the Republic of Belarus of August 14, 2015 No. 51/94 "About the documents necessary for investigation and accounting of labor accidents and occupational diseases" (The national legal Internet portal of the Republic of Belarus, 13.11. 2015, 8/30346).

10. The procedure for technical investigation of the reasons of accidents and incidents on GTS is established by the Instruction about procedure for technical investigation of the reasons of accidents and incidents, and also their accounting approved by the resolution of the Ministry of Emergency Situations of the Republic of Belarus of July 12, 2016 No. 36 (The national legal Internet portal of the Republic of Belarus, 31.08.2016, 8/31230).

11. Stores, industrial and household rooms, devices of passes, bridges, wells, and also purity of the waters dumped in water objects from stores (if dumping is provided by the project), shall meet the requirements of these rules, the NPA and requirements of TNPA, obligatory for observance.

12. The equipment, designs, pipeline fittings, instrumentations and automatic equipment (further - instrumentation and automated control systems) systems and constructions of stores which are not provided by the project can be established only in case of approval of the organization which developed the project.

13. Commissioning of GTS unfinished by construction according to the project, is not allowed.

14. All mechanisms and the equipment of GTS shall be in good repair and to be completed according to the project.

15. To all objects of GTS the free entrance of vehicles shall be provided.
