About the Procedure for entering into the Eurasian economic commission and preparation by the Eurasian economic commission of offers on introduction or cancellation of single measures of non-tariff regulation

1. Approve the enclosed Procedure for entering into the Eurasian economic commission of offers of state members of the Eurasian Economic Union on introduction or cancellation of single measures of non-tariff regulation.

2. Determine that the offer of the Eurasian economic commission on introduction or on cancellation of single measures of non-tariff regulation is prepared by department of the Eurasian economic commission within which competence questions of non-tariff regulation, according to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98 are.

3. Ceased to be valid according to the Decision of Board of the Eurasian economic commission of 27.04.2015 No. 45

4. This Decision becomes effective after 30 calendar days from the date of its official publication.

Procedure for entering into the Eurasian economic commission of offers of state members of the Eurasian Economic Union on introduction or cancellation of single measures of non-tariff regulation

1. This Procedure is developed according to Item 9 of the Protocol on measures of non-tariff regulation concerning the third countries (appendix No. 7 to the Agreement on the Eurasian Economic Union of May 29, 2014) and determines the procedure of entering into the Eurasian economic commission (further - the Commission) offers of state members of the Eurasian Economic Union on introduction or on cancellation on customs area of the Eurasian Economic Union of single measures of non-tariff regulation concerning the third countries (further respectively - the offer, state members, the Union, measures).

2. The offer goes to the Commission the public authority of state member authorized according to the legislation of this state on interaction with the Commission.

3. The offer shall contain:

a) the appeal to the Commission on form according to appendix;

b) the draft decision of Board of the Commission if the decision on introduction or on cancellation of measure according to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98 (further - Regulations), is accepted by Board of the Commission;

c) the draft decision of Council of the Commission if the decision on introduction or on cancellation of measure according to Regulations is accepted by Council of the Commission;

d) the explanatory note containing the following information:

the bases according to which introduction or cancellation of measure, including information on application at least is offered to one of measure state members unilaterally;

detailed description of proposed measure;

the name, properties and characteristics of goods (goods) concerning which introduction or cancellation of measure is offered (further - goods);

the description and the characteristic (if necessary - quantitative and cost) the market of goods in the territory of the state member making the offer and also in the territory of the Union (in the presence of opportunity);

purposes of use of goods, his main consumers or customer groups;

assessment of effects of introduction or cancellation of measure for the market of goods in the territory of the Union and the forecast of possible actions of the third countries (in the presence of opportunity);

the data (including statistical) confirming availability of the bases for introduction of temporary ban or quantitative restriction of export or commodity import according to the Section III of the Protocol on measures of non-tariff regulation concerning the third countries (appendix No. 7 to the Agreement on the Eurasian Economic Union of May 29, 2014).

4. The department of customs and tariff and non-tariff regulation within 3 working days from receipt date of the offer in the Commission performs this offer regarding completeness of the provided materials, the stipulated in Item 3 presents of the Procedure. In the presence of all documents and data the offer is considered by the Commission according to Regulations.

In case of representation of materials not in full the Department of customs and tariff and non-tariff regulation sends to the public authority of state member authorized according to the legislation of this state on interaction with the Commission, the notification on refusal in consideration of the offer (with reasons).
