1. Approve the enclosed Rules of synchronization of works of systems of electronic purchase with work of the register of the goods, works and services used when carrying out transactions on subsurface use and their producers.

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (to Erzhanov A. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the vice-minister of investments and development of the Republic of Kazakhstan Rau A. P.

4. This order becomes effective on the expiration of ten calendar days after day of its first official publication.

Rules of synchronization of works of systems of electronic purchase with work of the register of the goods, works and services used when carrying out transactions on subsurface use and their producers

1. General provisions

1. These rules of synchronization of works of systems of electronic purchase with work of the register of the goods, works and services used when carrying out transactions on subsurface use and their producers (further - Rules) are developed according to the Law of the Republic of Kazakhstan of June 24, 2010 "About subsoil and subsurface use" (further - the Law) and determine procedure for synchronization of works of systems of electronic purchase with work of the register of the goods, works and services used when carrying out transactions on subsurface use and their producers.

2. Action of these rules does not extend on:

1) the subsoil users performing transactions on investigation or production of popular minerals;

2) the subsoil users acquiring goods, works and services according to the legislation of the Republic of Kazakhstan on public procurements;

3) the legal entities having subsurface use rights, fifty and more percent of shares (share) of which the national managing holding directly or indirectly owns;

4) other systems of electronic purchase located fully or partially in not the Kazakhstan segment of network.

3. In these rules the concepts and determinations established in the Law and also the following concepts are used:

1) the applicant - physical person or legal entity, being the owner and (or) the owner of system of electronic procurement and submitted the application in form according to appendix 1 to these rules (further - the request) on implementation of synchronization of works of systems of electronic purchase with work of the register of the goods, works and services used when carrying out transactions on subsurface use and their producers (further - the Register);

The applicant shall not be the affiliirovanny person to the legal entity performing comprehensive information and technological, technical support and extension of the Register and not to be it within five years preceding date of application, officials and workers of the Applicant shall not be connected by subordination with officials of this legal entity or the organizations - affiliates of this legal entity and not to be connected by subordination with these persons within five years preceding date of application;

2) the user - the applicant, the authorized person of the subsoil user or the subsoil user, and also affiliated the organizations of the subsoil user which will use synchronizable system for implementation of purchases as customers;

3) service - enrollment of transactions which realize certain logic and are available to network interaction via the interfaces based on transfer of electronic messages;

4) authorized body - authorized body in the field of the state support of industrial and innovative activities.

4. Synchronization of works of systems of electronic procurement with work of the Register (further - synchronization) is understood as transfer by means of information exchange to the Register of information signed by the EDS of the user in system of electronic procurement of the applicant.

5. Input in commercial operation of synchronization of works of systems of electronic procurement with work of the Register is performed by authorized body based on positive result of the acceptance tests which are carried out together with authorized bodies in the field of oil and gas and in the field of informatization.

6. For holding actions for input in commercial operation of synchronization of works of systems of electronic procurement with work of the Register the authorized body creates working group which part representatives of authorized body and authorized bodies in the field of oil and gas and in the field of informatization are.
