AGREEMENT BETWEEN THE GOVERNMENTS OF STATE MEMBERS OF THE SHANGHAI COOPERATION ORGANIZATION

About creating favorable conditions for the international motor transportations

The governments of state members of the Shanghai Cooperation Organization which are hereinafter referred to as by the Parties

aiming to strengthen mutual trust, friendship and equal cooperation between the states of the Parties,

being guided by the purposes and the principles of the Charter of the Shanghai Cooperation Organization of June 7, 2002,

recognizing importance of ensuring reliable and effective international motor transportations for development of the foreign trade bonds of the states of the Parties,

intending and to enhance further conditions of the international motor transportations of passengers and loads on the basis of the available experience and the corresponding international treaties,

agreed as follows:

Article 1.

Main objectives of this agreement are:

creating favorable conditions for the international motor transportations;

coordination of efforts of the Parties for development of the international motor transportations;

simplification and harmonization of documentation, procedures and requirements of the Parties concerning the international motor transportations.

Article 2.

The concepts used in this agreement mean the following:

"the international motor transportation" - transportation of goods or passengers on vehicles with crossing of border of the state and (or) through the territory of the state at least one of the Parties;

"carrier" - physical person or legal entity which is registered in the territory of the state of one of the Parties and is allowed according to the legislation of the state of this Party to implementation of the international motor transportations;

"driver" - physical person which is allowed by competent authority of the state of the Party to vehicle control;

"car driver license" - the document issued by competent authority of the state of the Party, granting the right to the driver to manage the vehicle;

"permission" - the document issued by competent authority of the state of the Party, granting the right to use in the territory of the state of this Party the vehicle registered in the territory of the state of other Party for accomplishment of the international motor transportation;

"special permission" - one-time permission to journey of the vehicle of carrier of the state of one Party with heavy, bulky or dangerous goods on the territory of the state of other Party which issued such permission according to the legislation of the state;

"vehicle":

in transit passengers - the bus, that is the vehicle designed and intended for transportation of passengers, having more than 9 places for sitting including driver's seat, including the vehicle with trail car for luggage transport when transporting on the territory of the states of those Parties which legislation does not prohibit operation of such trail cars;

in transit loads - the vehicle designed and intended for transportation of goods including the cargo vehicle, the trailer hauling truck, the tractor truck and the tractor truck with semitrailer truck.

Article 3.

1. According to this agreement of the Party grant to carriers the right to implementation of the international motor transportations on the territory of their states by the vehicles registered in the territory of the state of one of the Parties.

2. The carrier registered in the territory of the state of one Party has no right to perform transportation of goods or passengers by the vehicle between the Items located in the territory of the state of other Party.

Article 4.

1. The international motor transportations based on this agreement are performed along routes and through check points through frontiers according to Appendix No. 1. This provision does not influence application of bilateral and multi-lateral international treaties which participants are the states of the Parties providing possibility of implementation of the international motor transportations without determination of routes and check points through frontiers or other routes and border check-points.

2. The question of modification and amendments in routes and (or) check points through frontiers is considered within the Joint commission on creating favorable conditions for the international motor transportations established according to Article 17 of this agreement (further - the Joint commission), after its approval by the Parties on which territory of the states such routes lie and (or) check points through frontiers are located.

Article 5.

The international motor transportations are performed based on permissions according to Appendix No. 2, except as specified when bilateral or multi-lateral international treaties which participants are the states of the Parties, provide possibility of implementation of the international motor transportations without permissions.

Article 6.

1. Dimensional and weight, including axial, loadings and other parameters of the vehicles used for implementation of the international motor transportations shall conform to requirements of the legislation of the state of the Party on which territory such transportation is carried out.

2. If dimensions or weight of the vehicle going without load or with load exceed the regulations established by the legislation of the state of the Party on which territory it is supposed to perform the international motor transportation with use of this vehicle carrier shall get previously special permission of competent authorities of this Party according to the legislation of this state.

Article 7.

1. When implementing transportations based on this agreement on the terms of reciprocity the states of one Party imported by carrier in the territory of the states of other Parties are exempted from taxation by customs fees, duties and taxes:

a) the fuel which is in the reservoirs provided by manufacturing plant for each model of the vehicle, technologically and structurally connected with engine power supply system and also the fuel which is in the reservoirs established by manufacturing plant on trail cars and semitrailer trucks and intended for work of heating or cooling installations of this vehicle;

b) lubricants in the quantity necessary for operation of the vehicle during transportation;

c) the spare parts and tools intended for repair of the vehicle damaged in transit performing the international motor transportation.

2. Specified in the subitem in) Item 1 of this Article unused spare parts and tools are subject to the return export. The replaced spare parts shall be exported back or placed under customs procedure (mode) of destruction or other customs procedure (mode) according to the procedure, established by the customs legislation of the state of the Party in the territory of which there is change of customs procedure (mode) concerning these spare parts.
