1. Approve the enclosed Rules of appointment and carrying out certification of the head of the state company, and also coordination of its candidate.

2. To department of policy of management of the state assets of the Ministry of national economy of the Republic of Kazakhstan:

To provide 1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and official publication in mass media;

2) to bring this order to the attention of the central state and local executive bodies;

3) to provide placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan and in information system of law of Ad_let.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective from the date of its state registration in the Ministry of Justice of the Republic of Kazakhstan and is subject to official publication.

Rules of appointment and carrying out certification of the head of the state company, and also coordination of its candidate

Chapter 1. General provisions

1. These rules are developed according to the Law of the Republic of Kazakhstan "About state-owned property" (further – the Law) and determine procedure for appointment and carrying out certification of the head of the state company (further – the company), and also coordination of its candidate.

1-1. Requirements of these rules do not extend to the first heads of the separate companies of education and culture appointed to position and dismissed by the President of the Republic of Kazakhstan, the first heads of the organizations of secondary education in form of business of the state companies on the right of economic maintaining appointed to position according to the legislation of the Republic of Kazakhstan in the field of education.

Persons enlisted in the Presidential youth personnel reserve can be appointed to position of the director in coordination with authorized body of the corresponding industry (local executive body or the office of the akim of the city of district value, the village, settlement, rural district) without carrying out tender, in case of compliance with qualification requirements of stipulated in Item 4 these rules.

2. Appointment and carrying out certification of the director, and also coordination of its candidate are made by authorized bodies of the corresponding industry (local executive bodies or offices of the akim of the city of district value, the village, settlement, rural district).

3. Approval of candidate for the head of the state company is performed in the state companies on the right of economic maintaining with the supervisory board.

Chapter 2. Procedure for appointment of the head of the state company

4. The main requirements in case of selection of candidates for position of the director are:

1) availability of the higher education conforming to qualification requirements;

2) availability of length of service at least 5 years in the specialty on executive positions in field of activity of the Company, according to general qualifiers of the types of economic activity approved by authorized body in the field of technical regulation;

3) for candidates for position of the head of the state company which is the state scientific organization, length of service in at least 5 years in the presence of degree of the doctor of philosophy (PhD), the doctor on profile, the candidate of science or the doctor of science, length of service at least 3 years.

5. For participation in tender the following persons are not accepted:

1) is younger than eighteen years;

2) earlier committed corruption crime;

3) having the outstanding or not removed in the procedure established by the legislation of the Republic of Kazakhstan criminal record;

4) other cases, stipulated by the legislation Republic of Kazakhstan.

6. Authorized body of the corresponding industry (local executive body or office of the akim of the city of district value, village, settlement, rural district):

1) makes the decision on carrying out tender;

2) determines conditions, date and the venue of tender;

3) creates the contest committee (further - the Commission), appoints the commission chairman from among representatives of authorized body of the corresponding industry (local executive body or the office of the akim of the city of district value, the village, the settlement, the rural district) and the secretary of the Commission.

7. The number of members of the commission makes odd number, at least five people.

8. The commission performs the following functions:

1) prepares the tender documentation;

2) provides the publication of the announcement of carrying out tender at the expense of means of the relevant company;

3) makes acceptance, registration and storage of the documents submitted for participation in tender;

4) following the results of tender is brought in authorized body of the corresponding industry (local executive body or the office of the akim of the city of district value, the village, settlement, rural district) by the decision.

9. The announcement of carrying out tender on holding the post of the head of the republican, regional and district company is published in official mass media, and also on Internet resource of authorized body (local executive body or the office of the akim of the city of district value, the village, the settlement, the rural district) in the state and Russian languages in fifteen calendar days prior to date of tender.

10. The announcement of carrying out tender contains the following data:

1) date and venue of tender;

2) the name of the company with indication of the location, the postal address, phone, the short description of its main activities;

3) requirements imposed to participants of tender;

4) term of submission of statements for participation in tender;
