1. Approve the enclosed Rules of determination of reasonable size of amount of consumption of regulated services by physical persons in the field of water supply.
2. To provide to committee on regulation of natural monopolies and protection of the competition of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) official publication of this order in information system of law of Ad_let and in periodic printing editions;
3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.
3. To impose control of execution of this order on the First vice-minister of national economy of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days from the date of its first official publication.

1. These rules of determination of reasonable size of amount of consumption of regulated services by physical persons in the field of water supply (further - Rules) are developed according to subitem 4-1) of Item 1 of article 13 of the Law of the Republic of Kazakhstan of July 9, 1998 "About natural monopolies and the controlled markets" and determine procedure for determination of reasonable size of amount of consumption of regulated services by physical persons in the field of water supply for the purpose of economy of water and means of consumers.
2. The basic concepts applied in these rules:
1) the subscriber - one and more consumers using services of water supply in the residential and (or) non-residential premise;
2) water supply - set of the actions providing fence, storage, preparation, giving and distribution of water through water supply systems to water consumers;
3) the reasonable size of amount of water consumption - water consumption amount size on one person a month, necessary for satisfaction of drinking and domestic needs;
4) average monthly amount of water consumption - average amount of water consumption the month falling on one physical person;
5) the water management organization - the legal entity which activities are connected with regulation, delivery, reproduction of waters, water supply, water disposal and operation of water objects;
6) department of authorized body - Committee on regulation and natural monopolies and protection of the competition of the Ministry of national economy of the Republic of Kazakhstan.
Other concepts used in these rules are applied according to the legislation of the Republic of Kazakhstan.
3. The reasonable size of amount of water consumption is calculated the water management organization and is determined by department of authorized body separately for each water management organization in coordination with local executive body (akimat of area, city of republican value, the capital).
If the water management organization renders services of water supply in the territory of two and more areas, the reasonable size of amount of water consumption is calculated the water management organization separately for each area.
At the same time, the reasonable size of amount of water consumption is considered during consideration of the request for approval of the differential tariff on services of water supply and is approved by department of authorized body along with approval of the differential tariff on water supply services.
4. The reasonable size of amount of water consumption consists of the maximum average monthly amount of water consumption among the first 30% of the population consuming the smallest amount of water (No. 1) and the maximum average monthly amount of water consumption among the first 70% of the population consuming the smallest amount of water (No. 2).
5. For determination of the maximum average monthly amount of water consumption among the first 30% of the population consuming the smallest amount of water (No. 1) water consumption amount in cubic meters (m 3) in four quarters preceding application, or for the previous calendar year and the number of the living (registered) people on each subscriber - for the subscribers having individual metering devices of water are distributed according to appendix to these rules according to the following stages:
1) the amount of average monthly water consumption on one person is sorted by increase from the smallest to the greatest on the "Average Monthly Water Consumption on One Person" column;
2) the first 30% of the people consuming the smallest average monthly amount of water are determined by the Quantity of Registered column;
3) on the "Average Monthly Water Consumption on One Person" column there is the greatest average monthly amount of water consumption, among the first 30% of the population consuming the smallest average monthly amount of water.
6. For determination of the maximum average monthly amount of water consumption among the first 70% of the population consuming the smallest amount of water (No. 2) water consumption amount in cubic meters (m 3) in four quarters preceding application, or for the previous calendar year and the number of the living (registered) people on each subscriber - for the subscribers having individual metering devices of water are distributed according to appendix to these rules according to the following stages:
