About approval of the Procedure for functioning of electronic system of implementation of licensing of economic activity on construction of facilities IV and V categories of complexity

According to the paragraph of Item 5 of the Procedure for licensing of the economic activity connected with creation of objects of architecture, the Cabinet of Ministers of Ukraine approved by the resolution of December 05, 2007 No. 1396, I order the tenth:

1. Approve the Procedure for functioning of electronic system of implementation of licensing of economic activity on construction of facilities IV and V categories of complexity which is applied.

2. To department of state programs and development of housing construction (Kozlovskaya N. V.), to Department of normative legal regulation (Vernigor Yu. Yu.) together with the State architectural and construction inspection of Ukraine (Kudryavtsev A. V.) provide submission of this order on state registration in the Ministry of Justice of Ukraine.

3. This order becomes effective from the date of its official publication and is effective before entry into force of the Procedure for submission of documents in electronic form in body of the licensing and issue of documents in electronic form to them by means of telecommunication means of communication established by the Cabinet of Ministers of Ukraine according to part three of article 10 of the Law of Ukraine "About licensing of types of economic activity".

Procedure for functioning of electronic system of implementation of licensing of economic activity on construction of facilities IV and V categories of complexity

I. General provisions

1. This Procedure determines the mechanism of functioning of electronic system of implementation of licensing of economic activity by construction of facilities IV and V categories of complexity (further - System).

2. In this Procedure terms are used in the following values:

the system website - the isolated part of System on the Internet which is intended for informing subjects of the address, submission of the documents necessary for licensing of economic activity on construction of facilities IV and V categories of complexity, electronically with use of the digital signature;

the responsible person - the employee of the State architectural and construction inspectorate of Ukraine who has right of access to System;

electronic documents for receipt of the license - documents of the established form which are filed to body of licensing electronically by means of telecommunication means of communication for receipt of the license or modification of the list of work types on construction of facilities IV and V categories of complexity;

electronic office of System - the isolated part of System which is intended for the authorized work of the responsible person with electronic documents for receipt of the license;

access rights - the list of actions which the responsible person has the right to carry out in System.

Other terms in this Procedure are used in the values given in the Laws of Ukraine "About information security in information and telecommunication systems", "About administrative services", "About electronic documents and electronic document management" and "About the digital signature".

3. The system is intended for submission of documents electronically by means of telecommunication means of communication in body of licensing by providing:

possibilities of submission by the subject of the circulation of electronic documents for receipt of the license;

registration, processings and considerations of electronic documents for receipt of the license by the responsible person;

provisions to subjects of the circulation of information on condition and results of consideration of electronic documents for receipt of the license;

the information security processed in system according to requirements of the current legislation;

confirmations of integrity of electronic documents for receipt of the license and identifications of the subject of the address.

4. The main functions of system are:

access for subjects of the addressing information on procedure of licensing of economic activity on construction of facilities IV and V categories of complexity electronically through the website of System;

access to electronic documents for receipt of the license and their filling through the website of System;

imposing of the digital signature (further - the EDS) on the filled electronic forms;

submission of documents to body of licensing electronically by means of telecommunication means of communication with fixing of departure time and time of obtaining, integrity and authenticity of documents, specifying of their author and possibility of provision of the data allowing to trace history of movement of the document;

enciphering and disaggregation of electronic documents for receipt of the license by their transfer;

integrity checking of electronic documents for receipt of the license;

identification of the subject of the address with use of the EDS;

authorization of the responsible person in System;

registration and acceptance to work of electronic documents for receipt of the license;

fixations of processing stages and consideration of electronic documents for receipt of the license;

automatic informing subjects of the address on condition of consideration of electronic documents for receipt of the license;

automatic control of adherence to deadlines of implementation of licensing of economic activity on construction of facilities IV and V categories of complexity electronically;

quick search of electronic documents for receipt of the license in their details;

storage of electronic documents for receipt of the license in System according to the Law of Ukraine "About electronic documents and electronic document management";

management of access rights to information in System.

5. Users of System apply the EDS only on condition of use of well-tried remedies the EDS and availability of the strengthened certificates of open keys.

6. Holder Sistemy is the State architectural and construction inspection of Ukraine as body of licensing.
