The government of the Russian Federation and the Government of the Republic of Kazakhstan which further are referred to as with the Parties

for the purpose of creating favorable conditions for mutual exchanges and trade and economic relations between regions of two states,

proceeding from need of providing and development of the reliable and stable year-round message,

wishing to realize the decision on collateral actions on designing, construction, operation and servicing of the boundary bridge crossing through the river Kigach on the highway Astrakhan - Atyrau,

agreed as follows:

Article 1

In this agreement:

the term "bridge" is understood as the road bridge through the main bed of the river Kigach;

the term "boundary bridge crossing" is understood as the road bridge, and also auxiliary approaches to it and adjacent highways.

Article 2

Coordination of sales activity of this agreement is performed by authorized bodies of the Parties:

from the Russian Side - the Ministry of Transport of the Russian Federation;

from the Kazakhstan Side - the Ministry of Transport and Communications of the Republic of Kazakhstan.

In case of change of the authorized bodies of the Party without delay notify each other through diplomatic channels.

Article 3

The bodies responsible for designing, construction, operation and servicing of the boundary bridge crossing, are:

from the Russian Side - Federal Highway Agency and administration of the Astrakhan region of the Russian Federation;

from the Kazakhstan Side - the Ministry of Transport and Communications of the Republic of Kazakhstan.

Will be timely notified on changes of names or functions of the above-named responsible bodies of the Party through diplomatic channels.

Article 4

1. The parties agreed with the following principles:

the construction of the boundary bridge crossing shall not change the direction of water flow of the boundary river Kigach, cause change of its course, coastline and passing of the line of frontier, to cause damage to safety of navigation, ecological and other safety in this area;

the bridge shall be built jointly;

after completion of construction the bridge will become joint property of the Parties, its operation, content and servicing will be performed jointly.

2. The specific mode of operation, content and servicing of the boundary bridge crossing will be approved in addition by the bodies of the Parties specified in Article 3 of this agreement.

Article 5

1. For designing and construction of the boundary bridge crossing by the bodies of the Parties specified in Article 3 of this agreement create on the parity basis service of the single customer.

2. All expenses connected with construction of the bridge, including costs for design and exploration work with attraction of material resources and also other costs connected with bridge construction bear the Parties in equal shares.

3. Construction of transport approaches to the bridge, auxiliary objects and constructions each Party independently in the territory of the state performs and finishes along with completion of construction of the bridge.

4. When carrying out tender on construction of the boundary bridge crossing the specialized mostostroitelny organizations of the states of the Parties having experience of construction of out-of-class bridges, technical capabilities and the corresponding personnel are attracted on equal terms.

Article 6

After entry into force of this agreement the bodies specified in Article 3 of this agreement in the shortest possible time will hold negotiations on cooperation, will develop and will sign the necessary contractual documents regulating specific questions of construction of the boundary bridge crossing including regarding carrying out prospecting and project works, including approval of their results, the mode of operation and servicing of the bridge.

Article 7

The dispute resolution, arising in case of implementation of this agreement during construction, operation and servicing of the boundary bridge crossing, is performed by authorized bodies of the Parties by consultations and negotiations.

Article 8

In the consent of the Parties changes and/or additions which are drawn up by separate protocols can be made to this agreement.
