About measures for the state registration of the rights to lands of agricultural purpose

According to Items 3, 9 Regulations on the Ministry of Justice of Ukraine, No. approved by the Presidential decree of Ukraine of April 6, 2011 395, for the purpose of providing and protection of the rights and legitimate interests of owners, users of lands of agricultural purpose, sustainable development of agro-industrial complex and ensuring the state registration of the rights to lands agricultural purpose order:

1. Determine that:

1) the state registration of the rights to lands of agricultural purpose is carried out by the state registrars of the rights to real estate (further - the state registrars) territorial authorities of the Ministry of Justice of Ukraine in the location of the parcel of land, and also the state registrars of other territorial authorities of the Ministry of Justice of Ukraine which are effective within the respective area;

2) the state registration of the rights to lands of agricultural purpose can be carried out by the notary in the cases provided by the paragraph the fourth parts five of Article 3 and article 4-2 of the Law of Ukraine "About the state registration of the corporeal rights to real estate and their encumbrances" in the location of the parcel of land or within the respective area where such parcel of land is located.

2. Territorial authorities of the Ministry of Justice of Ukraine which state registrars will carry out the state registration of the rights to lands of agricultural purpose within area are determined by the head of the head territorial administration of justice in the corresponding administrative and territorial unit, proceeding from need, big load or temporary absence of the state registrars, by adoption of the relevant order.

3. Registration, accounting cases or documents which were issued drawn up or received by the notary, the state registrar (if registration proceedings are initiated in the location of the parcel of land), the state registrars of other territorial authorities of the Ministry of Justice of Ukraine, are effective within the respective area, in terms and/or schedules which are determined by the head of the head territorial administration of justice in the corresponding administrative and territorial unit, transfer to territorial authority of the Ministry of Justice of Ukraine in the location of such parcel of land according to the Procedure for document transfer in the field of the state registration of the rights to real estate and their encumbrances approved by the order of the Ministry of Justice of Ukraine of January 20, 2012 No. 111/5, registered in the Ministry of Justice of Ukraine on January 26, 2012 on No. 118/20431 (with changes).

4. Approve Changes in some orders of the Ministry of Justice of Ukraine which are attached.

5. To the public registration service of Ukraine (Onishchenko A. V.) provide:

use of personalized seal of the state registrar before its destruction in connection with dismissal of the official which according to the office powers assigned to it performs functions of the state registrar, or its transfer into other position;

fixing to person which according to the office powers assigned to it performs functions of the state registrar, number seal of the state registrar from the date of assignment of such person to position by the edition by the head of registration service of Head department of justice of administrative and territorial unit of the relevant order.

6. To the state company "Information center" of the Ministry of Justice of Ukraine (Bogdanov L. V.) take the adequate measures necessary for implementation of this order, including by providing easy access and work of the state registrars with the State register of the rights to real estate without restrictions within the corresponding administrative and territorial unit - area.

7. To department of interaction with authorities (Martynenko S. V.) to submit this order on the state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About the state registration of regulatory legal acts of the ministries and other executive bodies".

8. This order becomes effective from the date of its official publication.

9. To impose control over the implementation of this order on the First Deputy Minister Yemelyanov I. I.

Changes in some orders of the Ministry of Justice of Ukraine

1. In appendices 1-21 to the order of the Ministry of Justice of Ukraine of December 26, 2011 No. 3601/5 "About approval of forms of decisions of the state registrar of the rights to real estate and requirements to their registration", registered in the Ministry of Justice of Ukraine on December 27, 2011 on No. 1538/20276 (with changes):

"Sample and the description of seal" shall be replaced with words 1) in word heading "samples and descriptions of seals";

Item 1 to state 2) in the following edition:

"1. Approve enclosed:

1) Sample of personalized seal of the state registrar of the rights to real estate;

2) Description of personalized seal of the state registrar of the rights to real estate;

3) Sample of number seal of the state registrar of the rights to real estate;

4) Description of number seal of the state registrar of the rights to real estate.";
